That our current "Miss South Carolina", Danielle Davis of Greer, and all the contestants competing in the 2000 Miss South Carolina Pageant are extended the privilege of the floor of the House of Representatives on Wednesday, April 26, 2000, at a time to be determined by the Speaker, for the purpose of being recognized and congratulated on "Miss South Carolina Appreciation Day" for their statewide and community service and for being the special ambassadors they are for our communities and State.

Allison: A CONCURRENT RESOLUTION TO EXTEND THE BEST WISHES AND HEARTFELT CONGRATULATIONS OF THE MEMBERS OF THE GENERAL ASSEMBLY OF THE STATE OF SOUTH CAROLINA TO OUR CURRENT "MISS SOUTH CAROLINA", DANIELLE DAVIS OF GREER, ON THE SPECIAL OCCASION OF "MISS SOUTH CAROLINA APPRECIATION DAY".
Whereas, the members of the General Assembly are proud to have the opportunity to recognize our current "Miss South Carolina", Danielle Davis of Greer; and
Whereas, prior to winning the title of "Miss South Carolina", Miss Davis was crowned Miss Williamston; and
Whereas, this outstanding and loving young lady is the oldest child of George and Donna Davis. She has one brother, Colton, age 15, and one sister, Marla, age 14; and
Whereas, Miss Davis graduated from Riverside High School where she was the recipient of the prestigious Leadership Award from the student government. She was also a member of the National Art Honor Society; and
Whereas, this extremely talented eighteen year old has won twenty-six gold medals while competing in the United States Figure Skating Association. At age sixteen she was the youngest performer ever hired at Paramount Carowinds in Charlotte, North Carolina; and
Whereas, her platform as Miss South Carolina is promoting volunteerism and teaching children the importance and benefits of volunteering. Miss Davis has completed four thousand hours volunteering in the last two years. Further, she has founded an organization titled "Each One...Reach One" and its goal is leading others to help society by volunteering; and
Whereas, Miss Davis was awarded a four-year full scholarship to Converse College prior to becoming Miss South Carolina. Her talent in the competition was vocal performance, and she hopes to obtain a bachelor of music degree from Converse College and then proceed to Belmont University where she will seek a post graduate degree in vocal performance with a minor in music business and management; and
Whereas, Miss Davis' aspirations for the future are to pursue a career as a recording artist; and
Whereas, Danielle is not only brilliant in the academic sphere, she is also a caring and generous human being of deeply-rooted family values and impeccably high standards; and
Whereas, we are extremely proud of Danielle Davis and are delighted to recognize our "Miss South Carolina" as a goodwill ambassador and role model for our State and a representative of the Palmetto State who is making a difference. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That the members of the General Assembly of the State of South Carolina, by this resolution, extend their best wishes and heartfelt congratulations to our current "Miss South Carolina", Danielle Davis of Greer, on the special occasion of "Miss South Carolina Appreciation Day".

Whereas, Mr. C. Allan Tinsley was born in Spartanburg, the son of Fred R. and Louise Smith Tinsley; and the members of the General Assembly were saddened to learn of his sudden and unexpected death on Thursday, February 24, 2000; and
Whereas, Allan Tinsley completed his high school education at Irmo High School in 1972, was a 1976 graduate of the University of South Carolina where he received his bachelor of arts degree, received his master's degree in Public Administration from the University of South Carolina in 1983; and
Whereas, he was employed by the South Carolina Department of Health and Environmental Control where he served as the manager of the Compliance Monitoring section. He was involved with several national committees related to his work and also served his community in many ways as a member of Spring Valley Baptist Church and in other capacities; and
Whereas, Allan Tinsley was married to Donna Glenn Tinsley, our friend and colleague who works with the House Education and Public Works Committee, and was the loving father of two daughters, Claire Tinsley and Mary Louise Tinsley, all of whom survived him; and, in addition to his wife and children, Mr. Tinsley was survived by his parents and brothers, Edward (Fred) Tinsley and Gary Tinsley, all of Columbia; and
Whereas, with the loss of this fine man at a young and early age, the people of Columbia and South Carolina have lost a dedicated public servant, a person who was a wonderful husband and father, and a good friend; and
Whereas, the members of the General Assembly would like Donna, his children, and the other members of his family to know they are thinking of them in this time of sorrow. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That the members of the General Assembly, by this resolution, hereby express their profound sorrow upon the death of C. Allan Tinsley, of Columbia, and extend deepest sympathy to his family and many friends.

I am stating for the record my opposition to the proposed amendment. To date, the First Steps Program has only utilized $3 million of the previously appropriated $20 million state dollars. Together with private donations, the First Steps Program currently has roughly $26 million and with a new appropriation the total would be $46 million. With so many important programs and so few available dollars, I cannot vote for any additional money to go to a program that has not fully utilized existing funds.

Rep. QUINN raised the Point of Order that Amendment No. 228 was out of order under Rule 5.3 B in that the amendment had the effect of appropriating funds in excess of ten million dollars and therefore should include corresponding appropriation reductions and/or revenue increases.
Rep. COBB-HUNTER argued that the totals in the columns representing state funds were not in excess of ten million dollars.
Rep. W. MCLEOD argued that column 6 related exclusively to state funding and column 5 was simply a projection of federal matching funds added to state funding.
Rep. NEAL argued that Rule 5.3 applied to the totals in column 6, which reflected state funding.
Rep. SHEHEEN stated that under Rule 5.3 D (4) the appropriation act must include total funds approved for the next fiscal year and a listing of appropriations from the General Fund.
SPEAKER PRO TEMPORE HASKINS cited a precedent in the case of Walker vs. Durham (1901) which states that to appropriate money is to set it apart, to designate sums for a particular purpose or individual. He stated that based upon Rule 5.3 A, appropriations for the purposes of the General Appropriation Bill are defined as state funding only and that the total state funds appropriated in the amendment was less than ten million dollars. He therefore overruled the Point of Order.

So, the amendment was tabled.
I voted against Amendment No. 507 which allocated more dollars to Health and Human Services for several reasons. First, last fiscal year we appropriated $80 million new dollars to this agency. This year in this budget we almost doubled that and budgeted over $144 million dollars. There currently exists abuse and mismanagement at the Department of Health and Human Services. This budget also directed them how to spend funds and erradicate medicaid fraud. There are many request and needs throughout the State for funding. Neither of these amendments stated where the additional money would have come from and put the budget out of balance. This is not conservative fiscal policy. Earlier in the debate I proposed an amendment to increase medicaid funding to senior citizens which was defeated. I am not against health care for rural areas or seniors. It simply has to be allocated in a conservative fiscal manner.
