TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-23-435 SO AS TO PROVIDE THAT IT IS UNLAWFUL TO DISCHARGE A FIREARM WITHIN A RADIUS OF ONE-HALF MILE OF A SCHOOL UNDER CERTAIN CIRCUMSTANCES, AND TO PROVIDE A PENALTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-23-435. It is unlawful to discharge a firearm within a radius of one-half mile of the grounds of a public or private elementary, middle, or secondary school except as part of an official school or law enforcement function. A person that violates this provision is guilty of a felony and, upon conviction, must be fined not more than ten thousand dollars, or imprisoned not more than ten years, or both."
SECTION 2. This act takes effect upon approval by the Governor.
