TO PROHIBIT THE DEPARTMENT OF PUBLIC SAFETY FROM SELLING, OR OTHERWISE FURNISHING, SOCIAL SECURITY NUMBERS AND TO REQUIRE THE DEPARTMENT TO REQUEST THE DELETION OF SOCIAL SECURITY NUMBERS FROM ANY DATABASE PREVIOUSLY TRANSFERRED BY THE DEPARTMENT TO A THIRD PARTY WITH WHICH THE DEPARTMENT HAS CONTRACTED.
Whereas, an individual's social security number used by third parties, without the consent of the individual concerned, can subject an individual to an unreasonable invasion of privacy, fraud, and misappropriation of identity; and
Whereas, federal law does not permit businesses to force customers to provide social security numbers; and
Whereas, the public reasonably expects that state agencies entrusted with this information take every precaution to maintain the privacy of this information; and
Whereas, there does not appear to be any useful purpose served by the release to third parties of individual social security numbers contained in drivers' records maintained by the Department of Public Safety; and
Whereas, the future release of this information should be prohibited; and
Whereas, it is also appropriate that any contracting party which received this information in the past should delete this information from any records obtained from the department. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Notwithstanding any other provision of law, the Department of Public Safety shall not sell, provide, or otherwise furnish social security numbers in its records to private parties.
SECTION 2. The General Assembly directs the Department of Public Safety to request that a contracting party delete from its records any social security numbers obtained prior to the effective date of this joint resolution as a part of electronically stored information received pursuant to a contract with the Department of Public Safety.
SECTION 3. This joint resolution takes effect upon approval by the Governor.
