A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-7-305 SO AS TO PROHIBIT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FROM GIVING NOTICE TO HEALTH CARE FACILITIES PRIOR TO CONDUCTING AN INSPECTION OF THE FACILITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-7-305. Notwithstanding any other provision of law, the department may not provide notice to a health care facility prior to conducting an inspection of the facility pursuant to this article or to any other provision of law."

SECTION 2. This act takes effect upon approval by the Governor.
