TO AMEND SECTION 43-3-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COUNTY AND REGIONAL DIRECTORS OF THE DEPARTMENT OF SOCIAL SERVICES, SO AS TO ELIMINATE REGIONAL DIRECTORS, TO REQUIRE COUNTY DIRECTORS TO BE CLASSIFIED IN ACCORDANCE WITH THE STATE CLASSIFICATION PLAN AND SUBJECT TO THE MERIT SYSTEM RULE, AND TO DELETE THE PROVISION STATING THAT DIRECTORS SERVE AT THE PLEASURE OF THE DIRECTOR OF THE DEPARTMENT OF SOCIAL SERVICES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 43-3-40 of the 1976 Code, as last amended by Act 102 of 1995, is further amended to read:
"Section 43-3-40. (A) The director shall select a director for each county department, referred to in Chapters 1, 3, 5, 7, 9, 19, and 23 as the county director, to discharge the duties of such the office and may select regional directors to oversee the county directors.
(B) The salaries of county directors and any regional directors shall must be fixed by the director. The position of county director must be classified in accordance with the State Classification Plan. Salary ranges and rates of pay must be in accordance with the State Pay Plan. County directors are subject to the Merit System Rule, and entitled to the rights of noncompetitive promotion, reinstatement, appeal to the Merit System Council, and such other rights as may be prescribed by the Merit System Rule. In fixing these salaries the director shall consider the individual qualifications of the respective directors and the possibilities of their individual positions. The county director shall be is the chief executive officer of the county department and shall perform duties as are directed by the director, regional director, or as directed by law.
(B) Regional and county directors serve at the pleasure of the Director of the State Department of Social Services."
SECTION 2. This act takes effect upon approval by the Governor.
