TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 45-1-100 SO AS TO PROVIDE THAT FOR PURPOSES OF THE REGULATION OF FOOD PREPARATION AND SERVICE BY THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, A RETAIL FOOD ESTABLISHMENT DOES NOT INCLUDE A CHURCH OR CHARITABLE ORGANIZATION THAT PREPARES AND SERVES FOOD TO THE PUBLIC AT NOT MORE THAN ONE FUNCTION A MONTH OR TWELVE FUNCTIONS A YEAR.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 45-1-100. Notwithstanding the provisions of Regulation 61-25, for purposes of regulation of food preparation and service by the Department of Health and Environmental Control, a retail food establishment does not include a church or charitable organization that prepares and serves food to the public on their own premises at not more than one function a month or not more than twelve functions a year."
SECTION 2. This act takes effect upon approval by the Governor.
