TO AMEND SECTION 50-13-2020, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MANAGEMENT AND CONTROL OF LAKES AND PONDS OWNED OR LEASED BY THE DEPARTMENT OF NATURAL RESOURCES, SO AS TO DELETE THE REQUIREMENT THAT THE TERMS AND CONDITIONS FOR USE OF LAKES AND PONDS OWNED OR LEASED BY THE DEPARTMENT BE PUBLISHED IN A NEWSPAPER OF GENERAL CIRCULATION AND PROVIDE THAT THE TERMS AND CONDITIONS FOR THE USE MUST BE POSTED AT THE SITE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 50-13-2020 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:
"Section 50-13-2020. The department has management control over the lakes and ponds which it owns or leases. It may establish the terms and conditions under which the public may use the lakes and ponds for fishing, boating, picnicking, and other related activities. Before taking effect, the conditions and terms must be approved by the board and a majority of the county legislative delegation of the county where the lake or pond is located and published in a newspaper of general circulation in the county the terms and conditions for the use must be posted at the site.
Any person violating the terms and conditions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
