Give us hope that never changes to despair and loyalty that never diminishes. Arm our will with Your strength. Keep us steadfast in our discipleship. Grant to us the deep contentment of work completed and duty done in service to our God and to our fellowmen. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of Friday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Whereas, the Tigers brought together a powerful combination of experienced veterans and talented freshmen for the 2001 campaign and the team marched to victory six times during the regular season; after two tough wins over Central Florida and Wofford, the Tigers began a long and fierce season of conference play that included a thrilling overtime triumph over Georgia Tech, and exciting defeats of North Carolina State, Wake Forest, and Duke; and

Whereas, the Clemson Tigers traveled west to meet a tough Louisiana Tech team in the 2001 Humanitarian Bowl in Boise, Idaho on New Year's Eve and, after adjusting to the freezing temperatures of the Rocky Mountains, the Tigers put on an impressive offensive display gaining 273 yards on the ground and 275 yards through the air and pounded the Bulldogs by an amazing score of 49 to 24; and

Whereas, the 2001 Clemson Football Team made its mark in the school's record books by finishing the season with 5,184 yards of total offense, 369 points, and 49 touchdowns scored, the second highest totals in each of those categories in team history; and

Whereas, for Head Coach Tommy Bowden, along with his Assistant Coaches Brad Scott, Reggie Herring, Mike O'Cain, Rick Stockstill, Rodney Allison, Burton Burns, Jack Hines, Thielen Smith, and Ron West, to accomplish such outstanding achievements certainly takes a special caliber of exceptional athletes to perform at this impressive level of competition; and

Whereas, we would like to also recognize and commend Athletic Director Bobby Robinson, Associate Athletic Director Bill D'Andrea, Strength Training Director Joey Batson, Director of Sports Medicine Danny Poole, Assistant Athletic Director for Football Management Andy Johnston, and Assistant Athletic Director for Football Relations Don Hymel; and

Whereas, the Clemson Tigers finished the 2001 football season with a 7-5 overall record and Head Coach Tommy Bowden, along with his hard-working staff of assistant coaches have Tiger fans looking forward to many future seasons of high-powered Clemson Football; and

Whereas, the success of the 2001 Clemson Football Team has not only brought great pride to President James F. Barker, the faculty and administration, the enthusiastic students, and the loyal alumni and supporters, but also to the State of South Carolina. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the South Carolina General Assembly of the State of South Carolina, by this resolution, extend their sincere congratulations to the 2001 Clemson University "Tigers" Football Team and Head Coach Tommy Bowden on their outstanding winning season and applaud the Clemson "Tigers" on their tremendous victory in the 2001 Humanitarian Bowl.

Be it further resolved that a copy of this resolution be presented to Head Coach Tommy Bowden.

/ SECTION   1.   Section 56-3-210 of the 1976 Code, as last amended by Act 497 of 1994, is further amended to read:

"Section 56-3-210.   (A)   Persons A person who newly acquiring vehicles acquires a vehicle and owners of foreign vehicles or an owner of a foreign vehicle being moved into this State and required to be registered under this chapter, may have not more than forty-five days in which to register and license them. before operating the vehicle on the state's highways during the forty-five day period contained in this section must:

(1)   transfer a license plate from another vehicle pursuant to subsection (D) of this section and Section 56-3-1290;

(2)   purchase a new license plate and registration;

(3)   purchase a temporary license plate from the Division of Motor Vehicles pursuant to subsection (B) of this section;

(4)   purchase a temporary license plate from the county auditor's office in the county in which the person resides pursuant to subsection (b)_of this section; or

(5)   obtain a temporary license plate from a dealer of new or used vehicles pursuant to subsection (C) of this section.

(B)   The Division of Motor Vehicles, or the county auditor's office must, upon proper application, issue a temporary license plate approved by the Division of Motor Vehicles to an applicant pursuant to subsection (A) of this section. The Division of Motor Vehicles or the county auditor's office must insert clearly and indelibly on the face of the temporary license plate the date of expiration and other information the Division of Motor Vehicles may require. The expiration date may not extend beyond forty-five days from the vehicle's date of purchase. A bill of sale must be maintained in the vehicle at all times to verify its date of purchase to a law enforcement officer. The bill of sale must provide a description of the vehicle, the name and address of both the seller and purchaser of the vehicle, and its date of sale. The Division of Motor Vehicles may charge a five dollar fee for the temporary license plate which the Comptroller General must place into a special restricted account to be used by the division to defray the expenses of the division associated with the production and issuance of the temporary license plates. The county auditor's office also may charge a five dollar fee for the temporary license plate to defray the expenses of the county auditor's office associated with the production and issuance of the temporary license plates.

(C)   A dealer of new or used vehicles may issue to the purchaser of a vehicle at the time of its sale a temporary license plate that may

contain the dealer's name and location and must contain, in characters not less than one-quarter inch wide and one and one-half inches high, the expiration date of the period within which the purchaser must register the vehicle pursuant to subsection (E) of this section. The expiration date may not extend beyond forty-five days from the date of purchase. The temporary license plate must be made of heavy stock paper or plastic, inscribed with contrasting indelible ink, and designed to resist deterioration or fading from exposure to the elements during the period for which display is required. A bill of sale must be maintained in the vehicle at all times to verify the vehicle's date of purchase to a law enforcement officer. The bill of sale must contain a description of the vehicle, the name and address of both the seller and purchaser of the vehicle, and its date of sale. A dealer who issues a temporary license plate or allows a temporary license plate to be issued in violation of this section is guilty of a misdemeanor and, upon conviction, must be fined one hundred dollars for each occurrence.

(D)   If a person intends to transfer a license plate from one vehicle to another vehicle, he may place the license plate to be transferred on the newly acquired vehicle on the date of its purchase. The bill of sale and registration which corresponds to the license plate must be maintained in the newly acquired vehicle at all times to verify its date of purchase to a law enforcement officer. The purchaser must register the vehicle with the Division of Motor Vehicles within forty-five days from its purchase date.

(E)   A person must replace a temporary license plate issued pursuant to this section with a permanent license plate and registration card as required by Section 56-3-110 within forty-five days of acquiring the vehicle or moving a foreign vehicle into this State. A person who operates a vehicle in violation of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars."
SECTION   2.   Section 56-3-220 of the 1976 Code is repealed.
SECTION   3.   This act takes effect upon approval by the Governor. /

Smith, Snow, Stille, Stuart, Talley, Townsend, Trotter, Vaughn, Walker, Webb, Weeks, Whatley, Whipper, Wilder and Witherspoon: A CONCURRENT RESOLUTION TO REQUEST THAT THE DEPARTMENT OF TRANSPORTATION TO NAME THE INTERSECTION OF STATE HIGHWAY 162 AND TOWLES ROAD AND SALTER'S HILL ROAD IN CHARLESTON COUNTY AS THE "HENRIETTA GRANT INTERSECTION" IN HONOR OF THE LATE MRS. HENRIETTA GRANT OF HOLLYWOOD, SOUTH CAROLINA.

Whereas, where State Highway 162 intersects with Towles Road and Salter's Hill Road in Charleston County is a busily traveled thoroughfare used by the residents and visitors to Hollywood, South Carolina, and surrounding communities; and

Whereas, Mrs. Henrietta Grant of Hollywood, South Carolina, worked tirelessly over the years to have appropriate officials put a traffic light at this intersection in the interest of traffic safety; and

Whereas, in a recent terrible traffic accident, Mrs. Grant and her granddaughter were both killed at this location; and

Whereas, the members of the General Assembly believe it would be a fitting tribute to her memory if this intersection were named in her honor. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the South Carolina General Assembly, by this resolution, hereby request that the Department of Transportation name the intersection of State Highway 162 and Towles Road and Salter's Hill Road in Charleston County as the "Henrietta Grant Intersection" in honor of the late Mrs. Henrietta Grant of Hollywood, South Carolina. The department is requested to install appropriate markers or signs at places the department considers advisable containing the words "Henrietta Grant Intersection".

Be it further resolved that a copy of this resolution be forwarded to the Department of Transportation.

The Concurrent Resolution was adopted and sent to the Senate.

Whereas, the members of the General Assembly of the State of South Carolina were deeply saddened by the death of beloved educator, loving family man, and former legislator, Lewis Phillips of Greer, on December 19, 2001; and

Whereas, Lewis Phillips was born in Spartanburg on April 22, 1920, to the late Reverend Numa M. Phillips and Frances William Phillips. He graduated from Greer High School and Wofford College and received a masters degree from Converse College; and

Whereas, Lewis Phillips enlisted in the United States Army after the attack on Pearl Harbor and served in North Africa, Italy, and France. He was Commander of the 178th Artillery in the South Carolina National Guard until he retired as Full Colonel in 1969; and

Whereas, Lewis Phillips began teaching and coaching at Jordan High School, then became Principal of Tigerville Elementary. He eventually returned to his alma mater, Greer High School, where he taught, coached, and served as Principal. Greer High School honored Mr. Phillips by naming the Lewis Phillips Gymnasium after him; and

Whereas, Mr. Phillips retired from the Greenville County School System in 1976, and was elected to the South Carolina Legislature where he served for twelve years. After retiring from the Legislature, he served on the Higher Education Commission for ten years; and

Whereas, Lewis Phillips was a member of Fews Chapel United Methodist Church, where he had been Church Pianist, Choir Director, Chairman of the Administrative Board, and Sunday School teacher; and

Whereas, the General Assembly extends its sympathy to the family and friends of Lewis Phillips. He is survived by his wife, Carolyn Lane Phillips; daughters, Candace J. Phillips of Greer and Anne P. Black of Spartanburg; son, Luke Phillips of Greer; grandson, David G. Buckner of Stuttgart, Germany; granddaughter, Meredith E. Chandler of Lexington, Virginia; two great-grandsons; sister, Emily Phillips Weir of Blackstock; nephews, Blair Robertson and Conrad Robertson. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the General Assembly of the State of South Carolina, by this resolution, express their profound sorrow upon the death of former Legislator, Lewis Phillips of Greer, on Wednesday, December 19, 2001, and extend deepest sympathy to his family and many friends.
