"(D) It is unlawful for a person to take or have in possession more than five two red drum in any one day."

"(3) red drum (Sciaenops ocellatus) (channel bass or spottail bass) of less than fourteen fifteen inches in total length, or more than twenty-seven twenty-four inches in total length; or"

I would ask unanimous consent to have this Memorandum distributed to the members. It deals with the availability of maps for amendments under consideration and how to access them on your computer.
Next, ladies and gentlemen of the Senate, I want to give you a brief update today on the progress of redistricting in the Senate.
We are about to begin an important debate about a process that has its roots, of course, in our Constitution. We all are present in this Chamber today as a result of election decisions made by citizens back in our home districts. We are now charged with making important decisions about the boundaries of the districts that will elect future members of this body and the U. S. Congress and, of course, the House of Representatives across the way.
This is a difficult process that is demanding on a personal, as well as a political, level. However, we must not be distracted from the task before us. I am appealing to the Senate to have the will to come together as a body and to adopt districts that will provide fair representation to our voters in the coming decade.
As you know, I have attempted to reach out to every Senator in this Chamber by working to help create redistricting plans that focused on constitutional principles and traditional redistricting guidelines instead of partisan interests.
We have followed fair and lawful criteria in creating the voting districts that our citizens will use to elect candidates to Congress and the Senate. I am satisfied that the Judiciary Committee and the redistricting subcommittee have considered and adopted guidelines that bring honor to this process and to the Senate.
I want to report to the Senate about the work and efforts that have taken place over the past six months that bring us to this special session this morning.
The redistricting subcommittee worked hard to create an open process that would encourage citizen involvement and input, and we were successful.
Before deciding on the criteria for its redistricting efforts, the subcommittee traveled around the State to listen and focus on matters of interest to our citizens. The subcommittee held six public hearings in different parts of the State and gathered extensive citizen input before deciding on the criteria that would guide us through this process.
Before the first map was drawn, the subcommittee learned about communities of interest and other issues of concern to our citizens. We examined the new census data and the statutory and other requirements that apply to the creation of voting districts. We invited and received valuable public input and submissions to help guide us before I allowed the staff to attempt to draw the first district. And, I think that's an important thing that needs to be noted. We didn't even cut on the computers. And, I think that is a very important step in this process.
Our staff solicited comments and information from each Senator regarding the proposed districts and received responses from almost every member of the body. I want to thank the members of the subcommittee and the members of this body for their hard work in gathering this information and, in particular, to our staff. This staff has worked hours, countless hours, to make this reapportionment happen, to get your amendments, to verify them -- and, I'm going to tell you, they have proved that that is just the finest staff that you could have for a Judiciary Committee and it's one that we really, regardless of how you might feel about the plan or whatever -- I don't think you could ask for people that are willing to give more than this staff has been willing to give.
After conducting this thorough preparation, the subcommittee solicited and considered a number of actual redistricting plans proposed by the staff, public, the political caucuses, and various advocacy groups. Ultimately, the subcommittee decided on a sound plan which adheres to traditional redistricting criteria and complies with both the requirements of the Constitution and the Voting Rights Act.
I believe that the plan adopted yesterday, or I should say last week, by the Judiciary Committee demonstrates that members' concerns were taken into account in the drafting process wherever possible. However, as each of you know, it is impossible to draft any plan that can fully satisfy each and every Senator.
And candidly, there has been too much partisan rancor in this already difficult process. I have heard far too much talk of threats and efforts
So, let us proceed thoughtfully and carefully over the next few days, or the next few hours or whatever -- I don't want to encourage anybody to be long-winded -- observing the courtesy that keeps this body together. We need to talk. We need to debate, but we don't need to yell at one another or get personal. I hope we can disagree but still work together as members of this body. I know that different people will want to get different comments into the record apart from the prepared comments except to tell you, ladies and gentlemen of the Senate, that the most disappointing part of this for me has been -- and I say this to both Republicans and Democrats -- that I instructed this staff to go out and develop the criteria. Early on, I made it clear to them I did not want a maximization plan for the Republicans -- that, instead, we would run it on the basis of traditional criteria. And, I'm not going to call anybody's name except to say I know that politics now has gotten in the way.
This plan, the staff recommendation -- and I'm referring back to that plan before any Judiciary Committee/subcommittee actions -- with the exception and, I understand the Senator from Greenville's frustrations, but, I can't cure something that you can't cure.
But, for most of the others in here, Republican and Democrat, you ought to be supporting the staff recommendation plan. There might be some small adjustments that are needed. But, beyond that, congressional and on Senate, it was a fair plan. It was an objective plan. It kept politics as much as possible out of the picture. It didn't do violence to traditional districts and, the most disappointing part, is that hands from both parties have gotten into the mixture. We've got an executive branch that wants into the legislative bowl of soup on this and we should have been able to go forward and handle our plan.
I want to make it clear on the record we did not take our criteria and apply it to the House plan. We have not weighed in on the House of Representatives redistricting so our criteria have not been applied to
The Senator from Kershaw, if he were here, has been in as difficult of a situation as I've been in with trying to move this thing through. And, I've had to table amendments on both sides and then, I hear on one hand, "I'm soft on the Democrats" and then I hear if I do another way, "I'm being too pro-Republican" or whatever. The staff tried to come up with a plan. It should easily have 37-40 votes in the Senate -- easily, in my opinion. Everybody's entitled to his own opinion and that's my disappointment at this particular hour. We will continue to do the best that we can do and to look at it.
I'm going to close by simply saying that I will be looking at your amendments. Several years ago the Senator from Aiken -- and some others of you -- and I were on the same team on that reapportionment, and we accepted an amendment, as my memory recalls last time, from one Senator trying to help him out. Of course, we got grilled in depositions and then on the floor of the Senate, I mean on the floor of the Federal Court, over why the amendment was adopted and whatever.
So, it's not any dislike of you, your amendment, your region or whatever, but, as Chairman of the Judiciary Committee, I'm going to try to look objectively on the front end at the question of whether the amendment violates the criteria and, if it does, I'm going to fight you on the amendment -- because once we depart the criteria, we've departed. And, then, somebody else is going to be up. One of my good friends in here, I hear, has got a congressional plan. He and I are going to have to get into it over that plan. The plan doesn't fit the criteria and I'm going to fight the adoption of it. But, I just want to tell you, that's the tactic I'm going to take and weigh in on the criteria. I know there's some criticism on some districts. There are some problems I can't fix. If you start splitting VTD's, where do you stop splitting VTD's in the State?
The population variance -- we kept it where the courts indicate we need to be. I had one Senator tell me, "You can fix it. Just go up and increase your variance." Read the roadmap as to where we've been before. And, there's just no need to go back and repeat that mistake and, I guess, to say that experience ought to be our teacher and we're just going to do the best we can do with it today. But, it's no personal situation and, to the Senator from Greenville, I will reiterate -- if I
Anyway, with that, Mr. PRESIDENT, to tell you all where we are, we adopted the Judiciary Committee Report as the working model -- that does not prejudice you on your amendments. We made that clear in the last motion.
I will have an amendment up later. It is a technical amendment. The House, in our trying to be good neighbors to the folks across the Hall, we found some errors, some scriveners' errors, and we were going to correct them along the way. But, it seems that they got nervous and think there's some trap or something in there, so the amendment I've got will simply undo the corrections that we did to some House language that we just caught the scriveners' errors and let them handle that. That will be my last effort to try to fix things or improve things across the Hall. And, I do have an amendment up to undo that. And, I hope that will satisfy them.

I'm sorry. I just wanted to mention that thing about the scriveners' error because when I get up here on that amendment I am undoing what I think is their mistake, but they paddle their boat.

Senator LEVENTIS explained the amendment.
I wanted to give the Judiciary Committee the benefit of knowing more about the process the Democratic Caucus used to develop the plan it proffered so that the committee would have the benefit of information different than and in addition to the comments made by its staff. The staff was allowed to describe what they perceived to be weaknesses in the plan, although they admitted to being unable to study the plan in detail. At the time the plan was offered to the committee, Senator C. BRADLEY HUTTO requested that I be allowed to speak to its attributes. I am not sure why members of the Senate were denied the chance to make comments; the committee apparently had all the information it wanted to consider.
I want to highlight the traditional districting principles we prioritized in developing this plan. I will also discuss how we addressed the pertinent Voting Rights Act issues and the constitutional considerations, like one-person one-vote and remediation of the racial gerrymandering that remained in the plan, even after the 1997 plan was put into place.
As you know, I worked for the John McCain Presidential Campaign. I have prided myself in trying to act in a bipartisan manner on issues that should transcend partisan politics. Reapportionment is an issue the General Assembly should resolve every ten years. Yet, the South Carolina General Assembly has been unable to get through reapportionment without court intervention in 30 years.
The plan passed by the Judiciary subcommittee will not pass muster either in a court of law or the court of public opinion. Our plan offers some middle ground that will allow for some bipartisan cooperation and collaboration. Why is this plan a better plan?
1. The three-judge court in Smith v. Beasley held that South Carolina's single most important traditional districting principle was to respect political subdivisions, specifically counties and cities. They are our most recognizable communities of interest, as evidenced by the fact
Our plan keeps more cities and counties whole. Clearly, this plan is superior in that regard. Of course, some counties and cities must be split because their population exceeds the ideal district size. Still minimizing the number or splits is also an important districting principle. Again, our plan is clearly superior in this regard. The Democratic Caucus Plan has 21 whole counties or 40% more than the 15 whole counties in the Judiciary Plan. I realize your analysis is based on "county splits" but I prefer to count this vital statistic the way the average citizen does, not how the "professionals" count.
2. The population of each district should be as equal as possible given other important considerations. Our plan's deviation is far below the plus/minus 5% standard approved by the Supreme Court for state legislative districts.
3. There is no question that the existing plan retained much of the unconstitutional racial gerrymandering the Republican Party insisted on in 1993. The Smith v. Beasley litigation remedied only one unconstitutional majority minority district. The staff plan perpetuates much of that racial gerrymandering under the pretext of minimizing change from the present plan to a new plan which leaves the plan vulnerable to litigation. These race-based districts are often oddly shaped and were already found to be the product of racial gerrymandering used by the Republican Party during the 1993 Session on reapportionment to maximize the number of African-American voters in majority minority districts in order to limit the number of African-American voters in the other districts.
Our plan has been careful not to retrogress under Section V. We believe our plan is far superior on that important issue. We have endeavored to maintain and/or establish districts that provide an equal opportunity for minorities to elect the candidate of their choice. Section V of the Voting Rights Act does not establish a finite number of districts which must be created. Our plan contains 9 majority districts versus the 10 districts in the current (1997) plan and the Judiciary Committee Plan. We have not had a written report produced, but indications from our equal opportunity analysis from our expert proves that our plan creates equal opportunity for minorities to be elected in these districts. South Carolina can be proud of the fact that its recent election history demonstrates a real and progressive reduction in the incidence of racially polarized voting. This is an important fact in that it undergirds the fact that the minority population in a majority minority district can, depending on the local voting history, be substantially less than the old norm of 65%. Look at District 7 in the 2000 elections. An African-American Senator won an election against a white incumbent county office holder by a 63% margin in a district which was barely 50% minority population and a minority voting age population of less than 50%.
No plan is perfect but the plan advanced by the Democratic Caucus is a meaningful and substantive place to start. The Democratic Caucus Plan: maintains a population deviation which falls within the constitutional/judicial standard; corrects the constitutional violations in those districts not fixed under Smith v. Beasley; adheres to the traditional districting principles which the court enunciated three years ago; and does so while meeting the standards of the Voting Rights Act.

I voted to table the Democratic Caucus amendment just presented. It was an attempt to decimate the representation of District 24. The cigar-styled district cuts through neighborhoods and is completely counter to maintaining a compact district with a commonality of interest. The Democratic plan for District 24 is an attempt to lessen the wonderful people of Aiken County's representation in the South Carolina Senate.
Since the last reapportionment battle, we have campaigned through many election cycles. We have come to the realization and statistics have proven that positive changes have finally created a society where it is no longer necessary to have a district with 60-65% minority representation in order for an African-American to be elected. As a matter of fact, having districts with a minority population of 60-65% dilutes the possibility of a Black influence that is representative of the Black population of this State.
It is the position of the Black Caucus that more districts need Black influence rather than a majority population. As a matter of fact, any district with a Black voting age population (BVAP) greater than 30% is one where African-American voters have enough influence to substantially affect the choice of a Senator. A district with a BVAP of only 20-30% creates a situation where Blacks have an impact. Because of this it is important for more districts to have Black influence and impact. Districts with a Black population of 60-65% do not accomplish this. It is only with more districts having Black influence and impact that Blacks will have appropriate representation that is sensitive to their issues of concern.
We cannot support any plan that packs African-Americans in super majority districts. Black districts marginalize the political strength of the Blacks of this State. Through experience we have learned that maximization equals marginalization.

I voted "aye" on third reading of H. 3003 in order that the Cities of Abbeville and Powdersville would remain in one Senate district.
I voted for third reading of H. 3003 because it afforded Georgetown County an opportunity for a new residential seat in District 43, Horry, Georgetown and Charleston Counties.
I voted against the plan because it violated the criteria for District 26. I had planned to vote for the plan because it met all the criteria for Spartanburg County, but the District 26 variations were too illegal for me to accept.

Amend the bill, as and if amended, by adding an appropriately numbered SECTION to read:
/ SECTION __. (A) The School District of Greenville County, through a policy adopted by the district's board of trustees, may elect to allow students residing inside the district but enrolled in home schooling programs to participate in extracurricular activities conducted by the district to the same extent as students enrolled in the district's schools.
(B) This election applies to students enrolled in home schooling programs pursuant to Sections 59-65-40, 59-65-45, and 59-65-47 who fulfill the eligibility criteria established for participation by public school students, other than the school attendance requirements.
(C) Home schooled students may only participate in extracurricular activities in a school in their attendance area. /

On motion of Senator McCONNELL, with unanimous consent, the Senate agreed that, when it adjourned today, it would stand adjourned under the provisions of Rule 1B and S. 583, the Sine Die Resolution, to meet in Statewide Session at 11:00 A.M. on Thursday, August 23, Friday, August 24, Monday, August 27, Tuesday, August 28, Wednesday, August 29, Thursday, August 30, and Friday, August 31, unless the House of Representatives nonconcurs in the Senate amendments and upon receipt of the Message from the House, the Senate would insist on its amendments and a Committee of Conference would be appointed and the Clerk would be authorized to send and receive messages incident thereto and the PRESIDENT would be granted leave to proceed to a Ratification of Acts, sending the appropriate messages.
And, further, when the Senate stands adjourned on Friday, August 31, 2001, it would stand adjourned to meet in Statewide Session at 12:00 Noon on Tuesday, September 4, 2001.

On motion of Senator RANKIN, with unanimous consent, the Senate stood adjourned out of respect to the memory of Mr. Cleveland L. Fladger of Myrtle Beach, S.C., beloved husband of Damoris, devoted father and grandfather. Mr. Fladger, a former school teacher, was a dedicated public servant having served also on the Conway City Council and the Horry County Transportation Committee.
