A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-15-95 SO AS TO PROVIDE THAT THE GOVERNING BODY OF THE JURISDICTION IN WHICH A MOTOR VEHICLE USED CAR DEALER OR USED CAR AUCTIONEER IS LOCATED IS THE ONLY GOVERNMENTAL BODY WHICH IS AUTHORIZED TO SPECIFY BY ORDINANCE OR OTHERWISE WHERE THE DEALERSHIP MAY BE LOCATED WITHIN THAT JURISDICTION AND THE SIZE, DESIGN, AND CONSTRUCTION OF THE FACILITY IN WHICH THE DEALERSHIP IS HOUSED, AND TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION IS NOT AUTHORIZED BY REGULATION TO SPECIFY ANY OF THESE CRITERIA AND ANY SUCH CRITERIA PREVIOUSLY ESTABLISHED ARE NULL AND VOID.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 15, Title 56 of the 1976 Code is amended by adding:

"Section 56-15-95.    The governing body of the jurisdiction in which a motor vehicle used car dealer or used car auctioneer is located is the only governmental body which is authorized to specify by ordinance or otherwise where the dealership may be located within that jurisdiction and the size, design, and construction of the facility in which the dealership is housed. The Department of Transportation is not authorized by regulation to specify any of these criteria and any such criteria previously established are null and void."

SECTION    2.    This act takes effect upon approval by the Governor.
