A HOUSE RESOLUTION

ESTABLISHING THE HOUSE OF REPRESENTATIVES FRIVOLOUS LAWSUIT STUDY COMMITTEE AND PROVIDING FOR ITS MEMBERSHIP, DUTIES, AND DURATION, AND REQUIRING THE COMMITTEE TO MAKE ITS REPORT AND RECOMMENDATIONS TO THE HOUSE NO LATER THAN JANUARY 14, 2004.

Be it resolved by the House of Representatives:

That there is established the House of Representatives Frivolous Lawsuit Study Committee consisting of nine members appointed by the Speaker as follows:

(1)    five members from the membership of the House, none of whom may be employed either in the legal profession or in the insurance industry, and one of whom to be designated by the Speaker to serve as chairman; and

(2)    four members who are private citizens appointed from the state at large, none of whom may be employed either in the legal profession or in the insurance industry.

The committee shall meet promptly and as often as necessary to conduct a thorough review of the incidence and impact of frivolous lawsuits on the efficient administration of South Carolina's civil justice system. The committee may conduct hearings and make relevant inquiries into the existence of lawsuit abuse in South Carolina and whether it is congesting our state's court rooms and increasing insurance liability costs. The committee shall submit its report and recommendations to the House of Representatives as soon as possible, but no later than January 14, 2004, at which time the committee is dissolved. The committee may be staffed by personnel designated by the Speaker from the House staff.
