A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 1-3-255 SO AS TO PROVIDE THAT BEGINNING JULY 1, 2003, THE GOVERNOR SHALL APPOINT A CABINET-LEVEL OFFICER TO BE KNOWN AS THE "CHIEF INFORMATION OFFICER" WHO SHALL SERVE AT THE PLEASURE OF THE GOVERNOR AND WHOSE DUTIES AND RESPONSIBILITIES SHALL INCLUDE ADMINISTERING OR COORDINATING THE ADMINISTRATION OF THE INFORMATION TECHNOLOGY FUNCTIONS AND PROCUREMENTS OF ALL CABINET-LEVEL AGENCIES AND DEPARTMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 1 of the 1976 Code is amended by adding:

"Section 1-3-255.    Beginning July 1, 2003, the Governor shall appoint a cabinet-level officer to be known as the 'Chief Information Officer' who shall serve at the pleasure of the Governor. The Chief Information Officer shall have those duties and responsibilities as assigned by the Governor but which shall include administering or coordinating the administration of the information technology functions and procurements of all cabinet-level agencies and departments referenced in Section 1-30-10(A). The Chief Information Officer shall receive such compensation as is provided by the General Assembly in the annual general appropriations act."

SECTION    2.    This act takes effect upon approval by the Governor.
