A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-1-165 SO AS TO REQUIRE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO IMPOSE, COLLECT, AND RETAIN FEES IN ADDITION TO THOSE CURRENTLY IMPOSED UNDER THE PROGRAMS AND SERVICES ADMINISTERED BY THE OFFICE OF ENVIRONMENTAL QUALITY CONTROL, BUREAU OF WATER, FOR THE PURPOSE OF GENERATING REVENUE TO FULLY FUND THE STATE PORTION OF REVENUE REQUIRED TO ADMINISTER THESE PROGRAMS AND SERVICES; TO ESTABLISH A MINIMUM ONE HUNDRED DOLLAR FEE FOR THOSE PERMITS, LICENSES, CERTIFICATES, AND REGISTRATIONS ISSUED BY THE BUREAU OF WATER FOR WHICH A FEE IS NOT CURRENTLY IMPOSED; TO REQUIRE THE DEPARTMENT TO PROMULGATE IN REGULATION THE TOTAL FEES TO BE IMPOSED PURSUANT TO THIS ACT AND OTHER PROVISIONS OF LAW; AND TO REQUIRE THE DEPARTMENT TO BIENNIALLY REVIEW THESE PROGRAMS AND SERVICES AND TO ADJUST THESE FEES ACCORDINGLY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 44 of the 1976 Code is amended by adding:

"Section 44-1-165.    (A)    The Department of Health and Environmental Control shall impose, collect, and retain fees, in addition to all fees currently imposed pursuant to law or regulation under programs and services administered by the Office of Environmental Quality Control, Bureau of Water, for the purpose of generating revenue to fully fund the state portion of revenue required to administer each program and service within the Bureau of Water.

The department shall calculate the additional revenue needed to fully fund the state portion of each program and service within the bureau and shall impose the additional fees based on the percentage of increase needed to generate the revenue necessary for that program or service. The fees collected for that program or service must be allocated to that program or service for the administration of that program or service. In establishing these fees, the department may round up the additional fee to the nearest twenty-five dollars.

(B)    For each permit, license, certification, or registration issued by the Bureau of Water for which a fee is not currently imposed, the department shall establish a minimum fee of one hundred dollars. These fees must be retained by the department and allocated to the program or service within the bureau responsible for issuing the respective permit, license, certification, or registration.

(C)    The department shall promulgate in regulation the total fee to be imposed pursuant to this section and any other provision of law or regulation on each permit, license, certification, or registration.

(D)    Biennially the department shall review the funding requirements of each program and service administered by the Bureau of Water and shall adjust the fees authorized by this section in accordance with the state funds needed to administer these programs and services."

SECTION    2.    This act takes effect upon approval by the Governor and applies to the funding of programs and services administered by the Department of Health and Environmental Control, Office of Environmental Quality Control, Bureau of Water, beginning July 1, 2004.
