A BILL

TO AMEND SECTION 8-21-310, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SCHEDULE OF FEES AND COSTS COLLECTED BY COUNTY CLERKS OF COURT, REGISTERS OF DEEDS, AND TREASURERS, SO AS TO IMPOSE A SINGLE FEE EQUAL TO FIFTEEN DOLLARS FOR THE RECORDING OF A MORTGAGE ON REAL ESTATE WHICH INCLUDES SUBSEQUENT RECORDING OF A SATISFACTION OF THAT MORTGAGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    A.    Items (1) and (5) of Section 8-21-310 of the 1976 Code, as last amended by Act 531 of 1990, is further amended to read:

"(1)    for recording a deed to or a mortgage on real estate, ten dollars; and an additional one dollar a page for any a deed or mortgage containing more than four pages; for entry of a deed or mortgage that covers both real estate and personal property in the indexes for both real and personal property conveyances or mortgages, one dollar additional;

(5)    for recording satisfaction on the record of a mortgage of real estate or a chattel mortgage or other recorded lien, and certifying the entry on the original or a copy, five dollars;"

B.    Section 8-21-310 of the 1976 Code, as last amended by Act 329 of 2002, is further amended by adding:

"(23)    for recording a mortgage on real estate, fifteen dollars, and an additional one dollar a page for a mortgage containing more than four pages; for entry of a mortgage that covers both real estate and personal property in the indexes for both real and personal property mortgages, one dollar additional. The fee for recording a mortgage on real estate includes the subsequent recording of satisfaction on the record of a mortgage of real estate and certifying the entry on the original or a copy;"

SECTION    2.    This act takes effect upon approval by the Governor and applies for mortgages on real estate recorded after June 30, 2004.
