The Judiciary Committee proposed the following Amendment No. 1 (Doc Name COUNCIL\SWB\5794CM04), which was adopted:
Amend the bill, as and if amended, Section 16-17-495(F) as contained in SECTION 1, page 2, by adding after line 38:
/ the provisions contained in this subsection apply to children less than sixteen years of age only. /
When amended Section 16-17-495(F) shall read:
/ (F) If a determination of custody has been made by a court order that is shown to a law enforcement officer as evidence of who is the legal custodian of the child, and the law enforcement officer has probable cause to believe that the child has been taken or is being withheld from his legal custodian in violation of this section, and the child is in a specific dwelling, building, structure, or vehicle, then the officer may:
(1) seek a warrant or court order to enter the dwelling, building, structure, or vehicle and use any reasonable means necessary to recover and return the child to his legal custodian; or
(2) enter the dwelling, building, structure, or vehicle without a warrant and use any reasonable means necessary to recover and return the child to his legal custodian if the officer has probable cause to believe the child's health or safety is in danger.
The provisions contained in this subsection apply to children less than sixteen years of age only. /

Whereas, the South Carolina Department of Natural Resources and other law enforcement agencies are responsible for boating safety, enforcement of fishing laws and regulations, and management of the diverse fishing resources on Lake Greenwood; and
Whereas, Lake Greenwood, located in Greenwood, Laurens, and Newberry Counties, is a valuable natural resource which is vital to the local and state economy and is an important recreational resource for many thousands of our state's citizens; and
Whereas, the Department of Natural Resources, in its role as steward of the natural resources and public safety on Lake Greenwood, maintains a staging area for law enforcement and fishery management at the lake; and
Whereas, Dr. Julius L. "Juke" Leary, Jr., is a prominent and respected doctor in Greenwood having served his patients with devotion since 1980; and
Whereas, he is a native of Greenwood County and graduated Summa Cum Laude from the University of South Carolina in 1976 and Cum Laude from the Medical University of South Carolina in 1980; and
Whereas, Dr. Leary has served two terms on the Board of the South Carolina Department of Natural Resources having recently retired from this position in July 2003; and
Whereas, Juke Leary is a community leader who has served numerous civic organizations, professional organizations, charitable
Whereas, he has received many honors and awards recognizing his medical skills, public service, and civic activities; and
Whereas, Dr. Leary is also among the State's leading conservationists; and
Whereas, the members of the General Assembly, by this resolution, would like to recognize and thank this distinguished South Carolinian for his many contributions to our State by naming the Lake Greenwood staging area in his honor. Now, therefore,

Rep. WHITE proposed the following Amendment No. 3 (Doc Name COUNCIL\NBD\12133AC04), which was adopted:
Amend the bill, as and if amended, by deleting Section 44-7-2910(A)(1) and inserting:
/(1) No direct care entity may employ or contract with a direct caregiver until after the direct caregiver has undergone a criminal record check as provided in this section. However, pending the results of the criminal record check, a person temporarily may be employed or may contract as a direct caregiver with a direct care entity. A direct care entity employing or contracting with a direct caregiver shall conduct a criminal record check as provided in this section prior to employing or contracting with the direct caregiver. A direct care entity may consider the all information revealed by a criminal record check as a factor in evaluating a direct caregiver's application to be employed by or contract with the entity./
Amend the bill further, by deleting Section 44-7-2910(C)(2) and inserting:
/ (2) A direct care entity unable to verify South Carolina residency for a direct care applicant for the preceding twelve months shall conduct a federal criminal record check on the applicant or conduct a in addition to the state criminal record check. However, if the direct care entity is located in a county of this State that borders either North Carolina or Georgia and the direct care applicant can verify residency in North Carolina or Georgia for the twelve months preceding the date of the employment application through the same means enumerated in (C)(1)(a) through (d), the direct care entity shall conduct only a state
