TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 2-3-115 SO AS TO ESTABLISH THE HONORARY POSITION OF SPEAKER EMERITUS, TO PROVIDE THAT THE POSITION IS HELD BY A PERSON WHO SERVED AS SPEAKER AFTER HIS SERVICE IN THE HOUSE, TO PROVIDE THE SPEAKER EMERITUS MAY PERFORM FUNCTIONS AND DUTIES ASSIGNED BY THE SPEAKER AND ALLOWED BY LAW, AND TO PROVIDE A SPECIAL LICENSE PLATE FOR THE SPEAKER EMERITUS; AND TO AMEND SECTION 2-3-110, RELATING TO THE SPEAKER AS CHIEF ADMINISTRATIVE OFFICER OF THE HOUSE OF REPRESENTATIVES, SO AS TO AUTHORIZE THE SPEAKER, AS ALLOWED BY LAW, TO APPROVE EXPENSE MONEY, STATIONERY, AND A PARKING SPACE IN THE MCEACHERN PARKING FACILITY FOR EACH SPEAKER EMERITUS, AND TO MAKE THE SPEAKER EMERITUS SUBJECT TO THE ETHICS ACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 3, Title 2 of the 1976 Code is amended by adding:
"Section 2-3-115. A member having served the House of Representatives in the capacity of Speaker is known, after that service in the House, as Speaker Emeritus. The position of Speaker Emeritus is an honorary one and is not an office of honor or profit as that term is defined in the Constitution of this State. The Speaker Emeritus may perform the functions and duties assigned by the Speaker and allowed by law. Each Speaker Emeritus is entitled without charge to a special motor vehicle license plate imprinted with the title 'Speaker Emeritus'. The plates must be numbered sequentially with the Speaker Emeritus who served the most distant in time having the plate imprinted with the number 'One'."
SECTION 2. Section 2-3-110 of the 1976 Code is amended to read:
"Section 2-3-110. (A) The Speaker is hereby designated as the department head and chief administrative officer of the House of Representatives. He is authorized to furnish his office and those of the various standing committees of the House with such the supplies and equipment as he deems considers necessary to be paid for from the approved accounts of the House.
(B) As allowed by law, the Speaker may approve a monthly expense allowance of one hundred dollars, stationery, and a parking space in the McEachern Parking Facility for each Speaker Emeritus, to be paid for from the approved accounts of the House. This subsection does not override the provisions of Act 248 of 1991, the State Ethics Act. The provisions of the Ethics Act apply to a person who has the honorary title of Speaker Emeritus."
SECTION 3. This act takes effect upon approval by the Governor.
