A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3890 SO AS TO PROVIDE THAT A DRIVER OF CERTAIN VEHICLES WHO CONTRIBUTES TO AN ACCIDENT WHICH MUST BE REPORTED TO THE UNITED STATES DEPARTMENT OF TRANSPORTATION SUCCESSFULLY SHALL COMPLETE A COMMERCIAL MOTOR VEHICLE DRIVER RETRAINING COURSE APPROVED BY THE DEPARTMENT OF PUBLIC SAFETY WITHIN NINETY DAYS OF THE ACCIDENT, AND TO PROVIDE A PENALTY FOR FAILURE TO COMPLETE THE COURSE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-3890.    (A)    A driver of a motor vehicle with six or more wheels, which is required to display a hazardous materials placard, or which is designed to transport sixteen or more passengers who contributes to a collision which is required to be reported to the United States Department of Transportation, shall complete successfully a commercial motor vehicle driver retraining course approved by the State Transport Police Division of the Department of Public Safety within ninety days of the collision.

(B)    A driver who fails to complete the course contained in this provision must have his driver's license suspended until he successfully completes the course."

SECTION    2.    This act takes effect upon approval by the Governor.
