A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-2380 SO AS TO PROVIDE PENALTIES FOR PERSONS WHO CAUSE INJURY OR DEATH WHEN FAILING TO YIELD THE RIGHT-OF-WAY UNDER CERTAIN CIRCUMSTANCES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 17, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-2380.    A person convicted of violating a provision contained in Sections 56-5-2310, 56-5-2320, 56-5-2330, 56-5-2350, 56-5-2360, or 56-5-2370 in which:

(1)    no great bodily injury or death resulted from the violation, in addition to any other penalty imposed for this violation, must be fined two hundred dollars, and have his driver's license, commercial driver license, or nonresident driving privilege suspended for thirty days;

(2)    great bodily injury resulted from the violation, in addition to any other penalty imposed for this violation, must be fined five hundred dollars and have his driver's license, commercial driver license, or nonresident driving privilege suspended for ninety days; or

(3)    death resulted from the violation, in addition to any other penalty imposed for this violation, must be fined one thousand dollars and have his driver's license, commercial driver license, or nonresident driving privilege suspended for six months."

SECTION    2.    This act takes effect upon approval by the Governor.
