A BILL

TO AMEND SECTION 20-7-1572, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO GROUNDS FOR TERMINATION OF PARENTAL RIGHTS, SO AS TO INCLUDE AS SUCH GROUND, THE CONVICTION OF A PARENT FOR THE MURDER OF THE CHILD'S OTHER PARENT.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 20-7-1572 of the 1976 Code, as last amended by Act 104 of 1999, is further amended by adding an appropriately numbered item to read:

"( )    A parent of the child pleads guilty or nolo contendere to or is convicted of the murder of the child's other parent."

SECTION    2.    Section 20-7-1564 of the 1976 Code is amended to read:

"Section 20-7-1564.    (A)    A petition seeking termination of parental rights may be filed by the Department of Social Services or any interested party.

(B)    The department may file an action for termination of parental rights without first seeking the court's approval of a change in the permanency plan pursuant to Section 20-7-766 and without first seeking an amendment of the placement plan pursuant to Section 20-7-764."

SECTION    3.    This act takes effect upon approval by the Governor.
