TO APPROVE REGULATIONS OF THE BOARD OF EDUCATION, RELATING TO CHARTER SCHOOL APPEALS, DESIGNATED AS REGULATION DOCUMENT NUMBER 2793, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Board of Education, relating to Charter School Appeals, designated as Regulation Document Number 2793, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
The State Department of Education recommends that the State Board of Education promulgate amendments to R 43-600, Charter Schools Regulation, and change title of regulation to Charter School Appeals, as indicated in the drafting notice that was published in the State Register on June 28, 2002. The amendments remove the right to remand a case to the local board of trustees by the State Board of Education and establish a process of appeal from the Charter School Advisory Committee to the State Board of Education, consistent with recent amendments to S.C. Code Ann. Section 59-40-10, et seq. (to be codified at Supp. 2002).
