To whom was referred a Bill (H. 4704) to amend Chapter 55, Title 44, Code of Laws of South Carolina, 1976, by adding Article 10 so as to require new septic tank installation to include an access pipe, etc., respectfully
That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking Section 44-55-910 of the 1976 Code, as contained in SECTION 1, and inserting:
/ Section 44-55-910. (A) An access pipe between a septic tank lid and ground level of sufficient size and design to allow tank access for monitoring the septic system operation and performing periodic pumping must be included in a septic system installed after June 30, 2004.
(B) The Department of Health and Environmental Control shall promulgate regulations to carry out the provisions of this article including, but not limited to, design and installation standards and penalties for violations. /

TO AMEND CHAPTER 55, TITLE 44, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 10 SO AS TO REQUIRE NEW SEPTIC TANK INSTALLATION TO INCLUDE AN ACCESS PIPE FOR MONITORING AND PUMPING THE SEPTIC SYSTEM, TO REQUIRE THE INSTALLATION OF SUCH A PIPE WHEN WORK IS BEING PERFORMED ON THE TANK, AND TO PROVIDE A CIVIL FINE FOR VIOLATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 55, Title 44 of the 1976 Code is amended by adding:
Section 44-55-910. (A) An access pipe between a septic tank lid and ground level of sufficient size and design to allow tank access for monitoring the septic system operation and performing periodic pumping must be:
(1) included in a septic system installed after June 30, 2004;
(2) installed on an existing septic system after June 30, 2004, when work is performed on the system that requires unearthing the tank.
(B) A person who fails to comply with the requirements of this section is subject to a civil fine imposed by the Department of Health and Environmental Control.
(C) The Department of Health and Environmental Control shall promulgate regulations to carry out the provisions of this article including, but not limited to, design and installation standards and penalties for violations."
SECTION 2. This act takes effect July 1, 2004.
