To whom was referred a Bill (H. 5088) to amend Section 23-35-50, Code of Laws of South Carolina, 1976, relating to the sale and storage of Class "B" fireworks used for display, etc., respectfully
That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, page 1, line 36, in Section 23-35-50(C), as contained in SECTION 1, by striking line 36 in its entirety and inserting therein the following:
/ (C) If Class 'B' fireworks used for display or agricultural purposes are returned to the /.
Renumber sections to conform.
Amend title to conform.

EXPLANATION OF IMPACT:
The Department of Labor, Licensing, and Regulation indicates this bill will have no impact on the department, the General Fund of the State, or federal and other funds.

TO AMEND SECTION 23-35-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SALE AND STORAGE OF CLASS "B" FIREWORKS USED FOR DISPLAY OR AGRICULTURAL PURPOSES, SO AS TO PROVIDE THAT DISPLAY OF CLASS "B" FIREWORKS RETURNED TO A WHOLESALER MUST BE RETURNED IN THE SAME MANNER THEY WERE SOLD, ISSUED, OR SHIPPED, INCLUDING ANY PROTECTIVE DEVICE ATTACHED TO THE FUSE OR FUSES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 23-35-50 of the 1976 Code is amended to read:
"Section 23-35-50. (A) Nothing in this chapter prohibits a licensed wholesale distributor from storing for sale where legal all Class 'B' fireworks used for display or agricultural purposes after first obtaining a license therefor for that purpose from the State Board of Pyrotechnic Safety. The cost of the license is seven hundred fifty dollars.
(B) Agricultural and display fireworks must be stored in an appropriate building and a record of purchases and sales must be kept for inspection by the State Board of Pyrotechnic Safety.
(C) If display of Class 'B' fireworks are returned to the wholesaler unused for any reason, the unused fireworks must be returned in the same manner they were sold, issued, or shipped, including any protective device attached to the fuse or fuses."
SECTION 2. This act takes effect upon approval by the Governor.
