TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION MAY NOT ERECT ANY TYPE OF BARRIER THAT WOULD RESTRICT ECONOMIC DEVELOPMENT ALONG INTERSTATE HIGHWAY 85 BUSINESS FROM ITS INTERSECTION WITH INTERSTATE HIGHWAY 585 TO ITS INTERSECTION WITH INTERSTATE HIGHWAY 26 IN SPARTANBURG COUNTY; AND TO PROVIDE THAT IF THE DEPARTMENT OF TRANSPORTATION MUST ERECT A BARRIER ALONG THIS PORTION OF HIGHWAY, THEN IT MUST OBTAIN APPROVAL FOR THE CONSTRUCTION PROJECT FROM THE SPARTANBURG COUNTY TRANSPORTATION COMMITTEE AND THE MEMBERS OF THE SPARTANBURG COUNTY LEGISLATIVE DELEGATION IN WHOSE DISTRICTS THE PROJECT WOULD BE LOCATED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The Department of Transportation may not erect any type of barrier that would restrict economic development along Interstate Highway 85 Business from its intersection with Interstate Highway 585 to its intersection with Interstate Highway 26 in Spartanburg County. However, if the Department of Transportation determines that it is necessary to erect a barrier along this portion of highway, then it must obtain approval for the construction project from both the Spartanburg County Transportation Committee and the members of the Spartanburg County Legislative Delegation in whose districts the project would be located.
SECTION 2. This act takes effect upon approval by the Governor.
