A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-9-35 SO AS TO PROVIDE THAT IF A PERSON HAS BEEN DECLARED PERMANENTLY DISABLED IN A FINAL ORDER OF THE WORKERS' COMPENSATION COMMISSION AND IS REQUIRED TO APPEAR BEFORE THE COMMISSION TO DEFEND HIS AWARD OF BENEFITS, HIS ATTORNEY'S FEE MUST BE PAID BY HIS EMPLOYER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 9, Title 42 of the 1976 Code is amended by adding:

"Section 42-9-35.    If a person has been declared permanently disabled in a final order of the Workers' Compensation Commission and is required to appear before the commission to defend his award of benefits, his attorney's fee must be paid by his employer."

SECTION    2.    This act takes effect upon approval by the Governor.
