VERSIONS OF THIS BILL
TO AMEND ACT 518 OF 1982, RELATING TO THE BERKELEY COUNTY BOARD OF EDUCATION, THE ELECTION OF ITS MEMBERS, THE PREPARATION OF THE ANNUAL OPERATIONAL BUDGET FOR THE SCHOOL DISTRICT OF BERKELEY COUNTY, AND SETTING OF THE NECESSARY TAX MILLAGE TO SUPPORT THE BUDGET, SO AS TO REQUIRE THE BUDGET TO BE SUBMITTED BY THE BOARD TO THE BERKELEY COUNTY COUNCIL FOR APPROVAL PRIOR TO SETTING THE TAX MILLAGE NECESSARY FOR THE BUDGET BY THE COUNTY COUNCIL.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 5 of Act 518 of 1982 is amended to read:
"Section 5. Notwithstanding any other provision of law, the Berkeley County Board of Education is empowered to shall prepare an operational budget for the school district and to and submit it to the Berkeley County Council for approval. The county council, before approving the budget, must first conduct a public hearing on the budget. The county council after approving the budget, shall set the necessary tax millage for general school purposes of the district as reflected in the budget. For this purpose, the board council shall furnish to the Auditor and Treasurer of Berkeley County before the second day of September of each year the school budget of the district for the ensuing year together with a certification as to the tax millage set by the board council in order to finance the general school purposes of the district for that year as reflected in the budget. This tax levy shall be assessed and collected in the same manner as other ad valorem property taxes are assessed and collected."
SECTION 2. This act takes effect upon approval by the Governor.
