A BILL

TO AMEND SECTION 11-35-1520, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COMPETITIVE SEALED BIDDING UNDER THE CONSOLIDATED PROCUREMENT CODE, SO AS TO PROVIDE THAT IN MAKING PROCUREMENTS WHICH REQUIRE BIDDING PURSUANT TO THIS SECTION, SOUTH CAROLINA FIRMS OR SOUTH CAROLINA PRODUCED OR MANUFACTURED PRODUCTS MUST BE AWARDED A TWENTY PERCENT PREFERENCE OVER OUT-OF-STATE FIRMS OR PRODUCTS, AND AMERICAN FIRMS OR AMERICAN PRODUCED OR MANUFACTURED PRODUCTS MUST BE AWARDED A TWENTY PERCENT PREFERENCE OVER FOREIGN FIRMS OR PRODUCTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 11-35-1520 of the 1976 Code, as last amended by Act 153 of 1997, is further amended by adding a new item appropriately numbered to read:

"( )    In making procurements which require bidding pursuant to this section, South Carolina firms or South Carolina produced or manufactured products must be awarded a twenty percent preference over out-of-state firms or products, and American firms or American produced or manufactured products must be awarded a twenty percent preference over foreign firms or products."

SECTION    2.    This act takes effect upon approval by the Governor.
