A JOINT RESOLUTION

TO CREATE A PUBLIC EDUCATION FUNDING STUDY COMMITTEE TO STUDY THE SYSTEM OF FUNDING PUBLIC EDUCATION IN THIS STATE IN GRADES K-12.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    A Public Education Funding Study Committee is created to study the system of funding public education in this State in grades K-12. The study must include ways to modernize, simplify, and make more equitable the manner in which public education is funded in this State.

(B)    The committee must be composed of ten members. Two must be appointed by the Chairman of the House Ways and Means Committee, two must be appointed by the Chairman of the Senate Finance Committee, two must be appointed by the Chairman of the House Education and Public Works Committee, two must be appointed by the Chairman of the Senate Education Committee, and two must be appointed by the Governor. The committee shall render its report and recommendations to the Governor and the General Assembly on January 15, 2006, at which time it shall dissolve. Each appointing authority in making their two appointments to the committee shall include a representative from an urban area of this State and a representative from a rural area of this State. Members of the committee shall serve until their successors are appointed and qualify, and vacancies must be filled for the remainder of the unexpired term in the manner of the original appointment. The committee must be co-chaired by the senior member of the Senate and the senior member of the House of Representatives who are serving on the committee. Notwithstanding the provisions of Section 8-13-770 of the 1976 Code, members of the General Assembly may be appointed to serve on this committee.

(C)    The staffing for the committee must be provided by the appropriate standing committees of the House and Senate, and employees of the State Department of Education, the school districts of this State, and other agencies as determined by the committee also shall assist and cooperate with the committee in the manner it determines appropriate.

SECTION    2.    This act takes effect upon approval by the Governor and the committee established in Section 1 of this act shall dissolve upon the filing of its report on January 15, 2006.
