A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-1040 SO AS TO PROVIDE THAT UNDER CERTAIN CIRCUMSTANCES THE DEPARTMENT OF TRANSPORTATION MAY ERECT SIGNS ALONG CERTAIN PORTIONS OF THE STATE'S HIGHWAYS THAT INDICATE THAT ALL PENALTIES ASSOCIATED WITH TRAFFIC VIOLATIONS THAT OCCUR ALONG THESE PORTIONS OF HIGHWAY ARE TWICE THE AMOUNT ALLOWED BY LAW.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 5, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-1040.    (A) Notwithstanding another provision of law, the Department of Transportation may erect signs along portions of the state's highways that indicate that all penalties associated with traffic violations are twice the amount allowed by law when the department determines that the portion of highway is dangerous based upon the number of traffic fatalities or injuries that have occurred along it.

(B)    The court must impose a sentence that is twice the amount allowed by law upon a person who is convicted of, pleads guilty to, or pleads nolo contendere to a traffic offense committed along a portion of highway identified in subsection (A)."

SECTION    2.    This act takes effect upon approval by the Governor.
