A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-71-297 SO AS TO PROVIDE THAT AN ENTITY THAT PAYS OR REIMBURSES HEALTH BENEFITS MAY NOT DISCRIMINATE IN THE AMOUNT PAID OR REIMBURSED FOR CHIROPRACTIC SERVICES AND TO REQUIRE THAT THESE SERVICES BE PAID OR REIMBURSED AS BILLED THROUGH THE SAME PROCEDURE CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 71 of Title 38 of the 1976 Code is amended by adding:

"Section 38-71-297.    A health benefit plan or another entity which pays or reimburses health benefits may not discriminate in the amount paid or reimbursed for chiropractic services. If two or more providers are authorized by their scopes of practice to provide the same or similar health care, the amount to be paid or reimbursed for the service billed through the same procedural code must be identical as it pertains to the chiropractic health benefit."

SECTION    2.    This act takes effect upon approval by the Governor.
