VERSIONS OF THIS BILL
TO AMEND SECTION 42-1-375, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS OF CERTAIN PERSONS FROM THE SOUTH CAROLINA WORKERS' COMPENSATION LAW, SO AS TO EXEMPT OWNER-OPERATORS OF VEHICLES LEASED TO MOTOR CARRIERS WHO HAVE SIGNED INDEPENDENT CONTRACTOR AGREEMENTS WITH A MOTOR CARRIER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 42-1-375 of the 1976 Code, as added by Act 438 of 1990, is amended to read:
"Section 42-1-375. This title does not apply to:
(1) a licensed real estate sales persons person engaged in the sale, leasing, or rental of real estate for a licensed real estate broker on a straight commission basis over whom the broker has no control and who has signed an independent contractor agreement with the broker; or
(2) an owner-operator of a vehicle leased to a motor carrier who has signed independent contractor agreements with a motor carrier."
SECTION 2. This act takes effect upon approval by the Governor.
