A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-101-430 SO AS TO PROVIDE THAT THE BOARD OF TRUSTEES OF AN INSTITUTION OF HIGHER LEARNING THAT IS VESTED WITH THE POWER OF EMINENT DOMAIN MAY NOT EXERCISE THE POWER OF EMINENT DOMAIN WITHOUT PRIOR APPROVAL FROM THE COMMISSION ON HIGHER EDUCATION AND THE STATE BUDGET AND CONTROL BOARD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section 59-101-430. The board of trustees of an institution of higher learning that is vested with the power of eminent domain may not exercise the power of eminent domain without prior approval from the Commission on Higher Education and the State Budget and Control Board."

SECTION    2.    This act takes effect upon approval by the Governor.
