A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-9550 SO AS TO PROVIDE THAT A LOCAL GOVERNMENT MAY NOT ENACT AN ORDINANCE THAT ALLOWS AN AUTOMATED TRAFFIC CONTROL SYSTEM TO BE INSTALLED AT A HIGHWAY INTERSECTION, AND TO PROVIDE A DEFINITION FOR THE TERM "AUTOMATED TRAFFIC CONTROL SYSTEM".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-95.    (A)    A local government may not enact an ordinance that allows an automated traffic control system to be installed at a highway intersection.

(B)    As used in this section, 'automated traffic control system' means a photographic device, radar device, laser device, or another electrical or mechanical device or devices designed to record the speed of a vehicle, obtain a clear photograph or other recorded image of a vehicle, the vehicle's operator, and the vehicle's registration plate, and display the time, date, and location of a vehicle while its driver is committing a traffic violation."

SECTION    2.    This act takes effect upon approval by the Governor.
