VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-25-70 SO AS TO PROVIDE THAT IF A TEACHER IS ARRESTED, THE ARRESTING LAW ENFORCEMENT AGENCY SHALL NOTIFY THE PRINCIPAL OF THE SCHOOL IN WHICH THE TEACHER IS EMPLOYED, PROVIDE THAT THE PRINCIPAL SHALL NOTIFY THE STATE BOARD OF EDUCATION OF THE ARREST, AND PROVIDE THAT THE STATE BOARD OF EDUCATION MAY REVOKE OR SUSPEND THE TEACHER'S CERTIFICATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 25, Title 59 of the 1976 Code is amended by adding:
"Section 59-25-70. (A) If a teacher is arrested, the arresting law enforcement agency shall make reasonable efforts to notify the principal of the school in which the teacher is employed of the teacher's arrest. Failure to make notification does not make the arresting law enforcement agency liable criminally or civilly.
(B) Upon notification pursuant to subsection (A), the principal shall notify the State Board of Education, which may revoke or suspend the teacher's certificate pursuant to this chapter."
SECTION 2. This act takes effect upon approval by the Governor.
