A BILL

TO AMEND SECTION 50-11-706, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROHIBITION AGAINST THE USE OF ARTIFICIAL LIGHTS TO OBSERVE OR HARASS WILDLIFE IN GAME ZONES 9 AND 10, SO AS TO PROVIDE THAT THE USE OF ARTIFICIAL LIGHTS FROM A VEHICLE OR WATER CONVEYANCE FOR THE PURPOSE OF OBSERVING OR HARASSING WILDLIFE IN GAME ZONE 9 IS UNLAWFUL AFTER 11:00 P. M. AND TO PROVIDE THAT ONLY THE OWNER OF THE REAL PROPERTY OR A PERSON WITH A LEGAL OR LEASEHOLD INTEREST THEREIN MAY USE ARTIFICIAL LIGHTS IN THE MANNER PERMITTED ABOVE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-11-706 of the 1976 Code is amended to read:

"Section 50-11-706.    (A)    The use of artificial lights from a vehicle or water conveyance for the purpose of observing or harassing wildlife in Game Zone 9 is unlawful after 11:00 P. M.. Only the owner of the real property or a person with a legal or leasehold interest therein may use artificial lights in the manner permitted by this subsection.

(A)(B)    In Game Zones 9 and Zone 10 the use of artificial lights from any a vehicle or water conveyance for the purpose of observing or harassing wildlife is unlawful. However, this section does not prohibit an owner of real property or a person with a legal interest therein from the use of artificial lights from any a vehicle or water conveyance for the purpose of surveying or protecting his property.

(B)(C)    Any A person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days.

(C)(D)    Nothing in this section may be construed to prohibit the lawful hunting of raccoon and fox."

SECTION    2.    This act takes effect upon approval by the Governor.
