I am hereby returning without my approval H. 3870 (Word version), R. 109, a Bill which increases the membership of the Startex-Jackson-Wellford-Duncan ("SJWD") Water District in Spartanburg County from five to seven members and allows one of the seven members to reside within the service area but outside the district.
My veto is based on my belief that this Bill is unconstitutional on at least two fronts. First, this Bill is unconstitutional because it allows for the appointment of a commissioner living outside the district to represent residents living inside the district. This violates Article 17, Section 1 of the South Carolina Constitution which provides that "[n]o person shall be elected or appointed to any office in this State unless he possess the qualifications of an elector..." A commissioner residing outside the district is clearly not a qualified elector of the district. The SJWD Water District's primary responsibility is to provide services to the residents inside its district. Allowing a commissioner who does not reside in the district to make decisions affecting district residents is similar to allowing a city councilman who lives outside the city to represent city residents. This is not only unconstitutional but it is unfair to district residents who expect a representative form of government.
Furthermore, the district also levies taxes only on residents inside the district to pay off general obligation debt for capital projects. This tax is not levied on residents in the service area outside the district boundaries. For a commissioner to have the authority to spend tax dollars that he does not have to pay himself rises to the level of non-representative government and "taxation without representation" in violation of the state constitution.
Second, I believe this Bill plainly violates the home rule provisions of the South Carolina Constitution. House Bill 3870 affects only Spartanburg County and is, therefore, clearly an act for a specific county. Such acts are in violation of Article 8, Section 7 of the Constitution of the State of South Carolina, which provides that "[n]o laws for a specific county shall be enacted." Acts similar to H. 3870 have been struck down by the South Carolina Supreme Court as violative of Article VIII, Section 7.
Based on the constitutional reasons I have stated above, I am vetoing H. 3870, R. 109.

Whereas, according to "A History of Georgetown County, South Carolina" by the late historian Dr. George Rogers, twenty years before the 1805 act that created the Town of Georgetown, the General Assembly allowed tax-paying residents of the unincorporated community to elect three commissioners each Easter who would be responsible for conducting business; and
Whereas, in 1787, the General Assembly provided for five commissioners and a clerk of town market to be elected on the first Monday in each April, and after Charleston was incorporated in 1783, a move got under way to incorporate Georgetown, with that effort being bearing fruit in 1805; and
Whereas, the 1805 Bicentennial Committee is working with city officials to replicate many of the events held one hundred years ago during the centennial celebration, while also making this celebration a reflection of 2005 and reflecting the growth and progress of the city in the last century; and
Whereas, Mayor Lynn Wood Wilson and Council Members Peggy Wayne, Brendon Barber, Clarence Smalls, Paige Sawyer, Jack Grimes, and Rudolph Bradley are committed to making this bicentennial celebration a great success; and

Whereas, Dr. Hines began his career as a teacher in Florence School District One, where he worked for twelve years, and in 1984 The Saint Paul Baptist Church ministry extended the invitation for the Rev. Hines to become the under Shepherd; and
Whereas, the Rev. Mack Hines' acceptance of the pastorate of Saint Paul marked the beginning of a long and prosperous era in the history of the church. Under his dynamic leadership, members are constantly added to the fellowship and the Rev. Hines has championed youth education by organizing ministers to raise money for exceptional high school students to further their studies; and
Whereas, Dr. Hines is vice president of the Pee Dee Baptist Association; past secretary of the South Carolina Baptist Educational and Missionary Convention; vice moderator of the Florence and Affiliated Counties Union; president of the Mullins Area Ministerial Alliance; past member of the Board of Trustees of Morris College; and life member of the National Association For The Advancement of Colored People; and
Whereas, in addition to all his other church and local community service, the Rev. Mack Hines has served as a member of the South Carolina House of Representatives since 1995. He also operates the Transitional Shelter For The Homeless, raising over two hundred thousand dollars for the homeless; and
Whereas, the Rev. Dr. Hines is the loving husband of the former Gladys Jackson, the proud father of three sons, Mack III, Michael, and Gregory, and the doting grandfather of two grandchildren and wants it

Whereas, during Sweetgrass Basket Days, the town and the Sweetgrass Cultural Arts Festival Committee seek to bring local, state, national, and international attention to this declining ancient African art form; and
Whereas, the Sweetgrass Cultural Arts Festival will provide an exciting opportunity for local sweetgrass basket makers to showcase their unique artistry and conduct demonstrations and workshops for the public; and
Whereas, festival goers will enjoy a variety of interesting Gullah Geechee skits, storytelling, gospel songs, and children's activities as well as some good old Lowcountry Gullah foods; and
Whereas, the Sweetgrass Cultural Arts Festival Committee and the Town of Mount Pleasant are excited to host the inaugural Sweetgrass Festival on the grounds of Laing Middle School in Mount Pleasant during the from June 1-4, 2005, at the Piccolo Spoleto celebration. Now, therefore,

The special license plate may have imprinted on the plate it an emblem, a seal, or other symbol that honors Vietnam War Veterans. The special license plate must be issued or revalidated for a biennial period which expires twenty-four months from the month it is issued. The fee for this special license plate is the regular motor vehicle registration fee contained in Article 5, Chapter 3 of this title and a special motor vehicle license fee of twenty dollars." /

(5) The House of Representatives and Senate shall meet at 12:00 p.m. on Tuesday, June 14, 2005, and shall adjourn not later than 5:00 p.m. on Wednesday, June 15, 2005. This meeting of the respective Houses of the General Assembly shall be solely for the purpose of receipt and consideration of gubernatorial vetoes, receipt of messages, receipt and consideration of conference and free conference reports, consideration of resolutions expressing congratulations or sympathy, receipt, consideration, and confirmation of magisterial appointments, receipt and consideration of local legislation which has the unanimous consent of the affected delegation, and election of officers to fill any vacancies or pending vacancies due to letters of resignation in offices in the House of Representatives or Senate. Be it resolved by the House of Representatives:
(1) That pursuant to the provisions of Article III, Section 12 of the Constitution of this State, the House of Representatives sets the following procedures for the election of officers to fill any vacancies or pending vacancies due to letters of resignation in the offices of the House of Representatives that may be held during the 2005 regular or extended session of the General Assembly:
(a) nomination speeches for the office shall be limited to one speech for each candidate with no speech exceeding ten minutes;
(b) no seconding nominations or speeches for a candidate are allowed;
(c) following the conclusion of nomination speeches, the House shall proceed to vote upon the candidates;
(d) unless unanimous consent is given to vote on the electronic roll call board, the Reading Clerk shall individually call each member's name, and each member may cast his vote "viva voce";
(e) a member may vote for only one candidate during a round of balloting;
(f) the Clerk of the House shall tally the votes for each candidate, and the presiding officer shall announce the vote totals for that ballot;
(g) after the presiding officer has begun to announce the vote totals for a ballot, a member may not change his vote to another candidate during that ballot; and,
(h) nothing contained in this resolution prevents the unanimous election of a candidate at the conclusion of a round of balloting by acclamation.
(2) If a candidate fails to receive a majority vote of those persons present and voting, the House shall proceed to successive ballots until a

Identification Cards Issued to and Firearm Qualification Provide for Retired Law Enforcement Personnel
Section 23-31-600. (A) For purposes of this section:
(1) 'identification card' is a photographic identification card complying with 18 U.S.C. Section 926C(d).
(2) 'qualified retired law enforcement officer' means any retired law enforcement officer as defined in 18 U.S.C. Section 926C(c) who at the time of his retirement was certified as a law enforcement officer in this State and who was trained and qualified to carry firearms in the performance of his duties.
(B) An agency or department within this State must comply with Section 3 of the Law Enforcement Officers Safety Act of 2004, 18 U.S.C. Section 926C, by issuing an identification card to any person
(C)(1) Subject to the limitations of subsection (E), a qualified retired law enforcement officer may carry a concealed weapon in this State if he possesses an identification card issued pursuant to subsection (C) along with a certification that he has, not less recently than one year before the date the individual is carrying the firearm, met the standards established by the agency for training and qualification for active law enforcement officers to carry a firearm of the same type as the concealed firearm.
(2) The firearms certification required by this subsection may be reflected on the identification card or may be in a separate document carried with the identification card.
(D) The restrictions contained in Sections 23-31-220 and 23-31-225 are applicable to a person carrying a concealed weapon pursuant to this section.
(E) An agency or department that does not establish and comply with written procedures for issuing an identification card to a qualified retired law enforcement officer within sixty days after a request is submitted shall not receive any grants or monies from the State, except as may otherwise be required by federal law, and is not entitled to send any individuals for training and education at the South Carolina Criminal Justice Academy.
(F) The agency or department may charge the retired law enforcement officer a reasonable fee for issuing the identification card and must provide the retired officer with the opportunity to qualify to carry a firearm under the same standards for training and qualification for active law enforcement officers to carry firearms. However, the agency or department may, as provided in 18 U.S.C. Section 926C(c)(5), require the retired officer to pay the actual expenses of the training and qualification." /

Whereas, sweeping demographic shifts have led to cost increases and the current Social Security system is facing insolvency; and
Whereas, without significant changes costs will exceed revenues in 2018 and the system will not be able to pay any benefits by 2042. The resulting effect will be that anyone born after the year 1970 will not receive any Social Security benefits; and
Whereas, to remedy this situation under the current system would require either a fifty percent tax increase on every working American or a thirty percent benefit cut; and
Whereas, allowing younger workers to invest a portion of their income in personal retirement accounts would facilitate a greater rate of return and retirement security while avoiding any benefit cuts and/or tax increases. Now, therefore,
Be it resolved by the Senate, the House of Representatives concurring:
That the members of the South Carolina General Assembly, by this resolution, request the Congress of the United States to enact no increases in payroll taxes, no cuts to Social Security benefits, and optional Social Security Personal Retirement Accounts.
Be it further resolved that a copy of this resolution be forwarded to the United States Senate, the United States House of Representatives, and to each member of the South Carolina Congressional Delegation.

Whereas, the new Arthur Ravenel Bridge in Charleston is one of the most amazing designs of an American bridge and is truly spectacular and awesome to all those who have seen it; and
Whereas, one prominent component of the Arthur Ravenel Bridge is the breathtaking view of the two towers that hold the cables that support the roadbeds; and
Whereas, when the Arthur Ravenel Bridge is opened it will replace the John P. Grace and Silas N. Pearman bridges which have served the Charleston community so well for so long; and
Whereas, John P. Grace was a former Charleston mayor in the 1920's and Silas N. Pearman was formerly South Carolina's Chief Highway Commissioner. The Grace bridge was completed in the late 1920's and the Pearman Bridge was completed in the late 1960's; and
Whereas, the General Assembly believes that to name these two towers in such a manner will be a wonderful way to preserve the memory of the two bridges that have meant so much to the people of Charleston. Now, therefore,
Be it resolved by the Senate, the House of Representatives concurring:
That the members of the General Assembly, by this resolution, request the Department of Transportation to name the two towers of the new Arthur Ravenel Bridge in Charleston as the "John P. Grace Tower" and the "Silas N. Pearman Tower" respectively in honor of the men for whom the two old bridges that will be replaced by the Arthur Ravenel Bridge will be named and to erect markers or signs at the appropriate places that contain the words "John P. Grace Tower" and the "Silas N. Pearman Tower".

Whereas, Jerry M. Alewine was elected to the Newberry County Council representing District Three in November, 2002, and served with distinction as a county council member from January, 2003, until his untimely death on August 12, 2003; and
Whereas, Jerry M. Alewine was dedicated and committed to the County of Newberry and its citizens, having served as board chairman of the Newberry County Memorial Hospital, as a member of the Newberry County Transportation Committee, and as a member of the Saint Philips Fire Department; and
Whereas, the professional career of Jerry M. Alewine was dedicated to providing modern, high quality roadways to the citizens of South Carolina inasmuch as he was a longtime public official of the South Carolina Highway Department from which he retired. He was later employed by Vulcan Materials and was also the owner of J. J. Line Striping; and
Whereas, Jerry M. Alewine was a lifelong member of Saint Philips Lutheran Church where he served on the church council, was a former Sunday School superintendent, and a former church financial secretary; and
Whereas, he was devoted to his lovely wife, the former Eleanor Amick, and they were blessed with two children, Nancy Alewine Stoudemire and Jerry Amick Alewine, and one grandchild, Ryan Joseph Stoudemire; and
Whereas, it is fitting and proper that the portion of South Carolina Highway 219 in Newberry County from Oxner Road (Road S-36-611) to United States Highway 176 be named "Jerry Alewine Memorial Highway" in memory of Jerry M. Alewine. Now, therefore,
