To whom was referred a Bill (S. 145) to amend the Code of Laws of South Carolina, 1976, by adding Section 50-13-390, to provide that no more than one Arkansas blue catfish over thirty-four inches, etc., respectfully
That they have duly and carefully considered the same and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking in its entirety Section 50-13-390, as contained in SECTION 1, and inserting:
/ "Section 50-13-390. (A) Notwithstanding another provision of law, no more than one Arkansas blue catfish over thirty-four inches may be taken from the waters of Lakes Marion and Moultrie by any one person in one day. The provisions of this section apply to commercial as well as recreational fishermen.
(B) A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned not more than thirty days. Each fish over the limit constitutes a separate violation." /
Renumber sections to conform.
Amend title to conform.

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-13-390, TO PROVIDE THAT NO MORE THAN ONE ARKANSAS BLUE CATFISH OVER THIRTY-FOUR INCHES MAY BE TAKEN FROM THE WATERS OF LAKES MARION AND MOULTRIE BY ANY ONE PERSON IN ONE DAY, AND TO PROVIDE THAT THE PROVISIONS OF THIS SECTION APPLY TO COMMERCIAL AS WELL AS RECREATIONAL FISHERMEN.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 13, Title 50 of the 1976 Code is amended by adding:
"Section 50-13-390. Notwithstanding any other provision of law, no more than one Arkansas blue catfish over thirty-four inches may be taken from the waters of Lakes Marion and Moultrie by any one person in one day. The provisions of this section apply to commercial as well as recreational fishermen."
SECTION 2. This act takes effect upon approval by the Governor.
