A BILL

TO AMEND ACT 1627 OF 1972, AS AMENDED, RELATING TO THE DORCHESTER COUNTY VOCATIONAL EDUCATION BOARD OF TRUSTEES, SO AS TO CHANGE REFERENCES FROM DORCHESTER VOCATIONAL EDUCATION TO DORCHESTER COUNTY CAREER AND TECHNOLOGY CENTER AND TO UPDATE LANGUAGE, TO PROVIDE THAT THE TWO MEMBERS APPOINTED FROM THE SCHOOLS DISTRICTS MUST NOT BE VOTING MEMBERS BUT SHALL SERVE EX OFFICIO, AND TO PROVIDE THAT THE OPERATIONAL BUDGET MUST BE SUBMITTED TO THE DORCHESTER COUNTY COUNCIL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Sections 1, 2, 3, and 4 of Act 1627 of 1972, as last amended by Act 363 of 2004, is further amended to read:

"Section 1.    There is hereby created in Dorchester County the Dorchester Vocational Education County Career and Technology Center Board of Trustees, which shall must be a body politic and corporate, and which shall consist of seven members as follows:

(1)    one member of the board shall must be appointed from each of the two school districts in Dorchester County by a majority of the board of trustees of the district from the membership of the board, and these two members shall must not be voting members but shall serve ex officio;

(2)    five members shall must be appointed by a majority of the Dorchester County Legislative Delegation.

All members Members shall serve for a term of three years and until their successors are appointed and qualify, except that of those initially appointed, the members appointed by the school districts shall serve for terms of two years and until their successors are appointed and qualify. Vacancies on the board of trustees shall must be filled in the manner of the original appointment for the unexpired portion of the term only.

Section 2.    As soon as possible after the approval of this act, the board shall organize by electing one of its members as chairman, one as vice-chairman and one as secretary. The chairmanship and vice-chairmanship shall must rotate among the three two school districts each two years and the chairman shall always must be from one of the districts and the vice-chairman from one of the other. Such This organization shall provide that, in order to have a quorum at any a meeting of the commission, at least four members of the board shall must be present, that each member present, including the chairman, shall have one vote and that the majority vote shall rule. Transcripts of the record of the organization must be filed with the secretary and administrative officer of the State Board of Education, with the county board of education of Dorchester County, and with the board of trustees of each of the school districts of Dorchester County.

Section 3.    The board shall adopt such organizational and administrative procedures as may be necessary further to develop, maintain, manage, and operate the facilities and programs, in addition to the following:

(a)    The legal title to all real and personal property heretofore and hereafter acquired before and after the effective date of this act for the vocational education career and technology center facilities and programs shall must be held by Dorchester County for the benefit of the three two school districts of the county, and each of the districts shall have an equity in the joint assets to the extent that the assessed tax value of the property within the school district bears to the aggregate assessed tax value of the property within the combined area of the districts.

(b)    The procedures by which vocational education career and technology funds appropriated by the Federal, State federal, state, or county government may be applied for and received for the benefit of the facilities and programs so operated shall must be such the procedures as that are required by the particular government making the appropriation or appropriations involved, and such the applications shall must executed by the chairman, or the vice-chairman, and the secretary of the board and by the vocational school career and technology center director of the area, and such the funds shall must be received by the board and the vocational school career and technology center director.

(c)    Each operational budget prepared by the board and by the board of trustees of the three two school districts of the county shall must be submitted to the county board of education of Dorchester County Council for approval and in conjunction with their requests for tax levies.

(d)    Subject to the provisions of this act and the provisions of Act 830 of 1966, the board shall have, in relation to the property, facilities, and programs, the general powers and duties of school trustees under pursuant to the general laws of the State.

(e)    The board is authorized to employ a vocational and technology center career and technology center director as the administrative official of the vocational education facilities and programs under the control of the board and he shall must be responsible to the board.

(f)    Subject to the approval of the board, each of the school districts shall have full authority to determine which pupils from its own district shall must be included in its quota of pupils enrolled at the vocational school career and technology center. For each year of operation of the school center after July 1, 1972, each of the districts may enroll in the school center a number of pupils from its own district up to but not exceeding the proportion which the total enrollment in the top three grades in its district bears to the total enrollment in the top three grades in all the districts combined and as such the proportion is applied to the student body capacity of the school center. If any a district does not enroll in the school center its full share of pupils for any a year, the other districts may enroll additional pupils from its district up to, but not exceeding, the number necessary to bring the student body of the school center up to capacity.

Section 4.    The Dorchester County Council is hereby authorized to may issue general obligation bonds of the county in an amount not to exceed one hundred seventy-five thousand dollars or such a portion of that amount as may be necessary to provide, along with other available funds, for the construction and equipping of a vocation school career and technology center in accordance with the provisions of this act. The proceeds derived from the sale of such these bonds shall must be disposed of as follows:

(a)    Any Accrued interest shall must be applied to the payment of the first installment of interest to become due on such these bonds.

(b)    Any A premium shall must be applied to the payment of the first installment of principal of such these bonds.

(c)    The remaining proceeds shall must be retained by the council and shall must be used to defray the cost of constructing and equipping the facilities hereinbefore described in this act."

SECTION    2.    This act takes effect upon approval by the Governor.
