A BILL

TO AMEND SECTION 56-15-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS WHO ARE SUBJECT TO PROVISIONS OF LAW REGULATING MOTOR VEHICLE MANUFACTURERS, WHOLESALERS, AND DEALERS, SO AS TO PROVIDE THAT INDIVIDUALS WHO, PURSUANT TO A WRITTEN AGREEMENT WITH A PROSPECTIVE PRIVATE PASSENGER MOTOR VEHICLE BUYER, AGREE TO ASSIST THE BUYER IN PROCURING A MOTOR VEHICLE OF THE BUYER'S CHOICE ARE NOT REQUIRED TO OBTAIN EITHER A WHOLESALER'S OR DEALER'S MOTOR VEHICLE LICENSE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-15-20 of the 1976 Code is amended to read:

"Section    56-15-20.        (A)    Any A person who engages directly or indirectly in purposeful contacts within this State in connection with the offering or advertising for sale or has business dealings with respect to a motor vehicle within this State shall be is subject to the provisions of this chapter and shall be is subject to the jurisdiction of the courts of this State upon service of process in accordance with the provisions of Chapter 9 of Title 15.

(B)    Notwithstanding the provisions of subsection (A) above, individuals who, pursuant to a written agreement with a prospective private passenger motor vehicle buyer agree, for a stated fee paid by the buyer to assist the buyer in procuring a motor vehicle of the buyer's choice are not required to obtain either a wholesaler's or dealer's motor vehicle license. The provisions of this section only apply if the exempt individual receives no form of remuneration of any kind from a motor vehicle manufacturer, wholesaler, or dealer in connection with the purchase."

SECTION    2.    This act takes effect upon approval by the Governor.
