A BILL

TO AMEND SECTION 1-11-730, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS ELIGIBLE TO PARTICIPATE IN STATE INSURANCE PLANS, SO AS TO PROVIDE THAT A LAW ENFORCEMENT OFFICER EMPLOYED BY AN ENTITY WHOSE EMPLOYEES ARE ELIGIBLE FOR STATE INSURANCE PLANS WHO IS PERMANENTLY DISABLED IN THE LINE OF DUTY AND WHOSE EMPLOYMENT IS TERMINATED AS A RESULT OF THE DISABILITY IS ELIGIBLE FOR STATE HEALTH AND DENTAL INSURANCE PLANS AND STATE-PAID PREMIUMS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1-11-730 of the 1976 Code is amended by adding:

"(I) An active law enforcement officer employed by an entity whose employees or retirees are eligible for state health and dental plans pursuant to Section 1-11-720(A) who was or would have been eligible for the plans who is:

(1)    permanently disabled in the line of duty and not as the result of his own misconduct, as the result of an accident, injury, or disease arising out of or in the course of his employment; and

(2)    whose employment is terminated as a result of the disability, is eligible for the state health and dental insurance plans and state-paid premiums effective on the date his employment is terminated on account of the disability. This participation and state-paid premiums continue while the disability continues."

SECTION    2.    This act takes effect upon approval by the Governor.
