THE COMMITTEE ON EDUCATION

To whom was referred a Bill (S. 414) to amend Section 59-149-50, Code of Laws of South Carolina, 1976, relating to eligibility for LIFE Scholarships, so as to revise eligibility and retention requirements, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by deleting all after the enacting words and inserting:

/ SECTION    1.    1.    Section 59-149-50(B) of the 1976 Code is amended to read:

"(B)    Students receiving a LIFE Scholarship to retain it and students currently enrolled in an eligible institution to receive such a scholarship must earn a 3.0 cumulative grade point average on a 4.0 scale each year and earn at least thirty credit hours each year for the maximum of semesters permitted at that institution by Section 59-149-60. The cumulative grade point average calculation, for purposes of LIFE scholarship eligibility, must be inclusive of the student's grade point average at all public or independent institutions attended by the student."

2.    The provisions of Section 59-149-50(B) of the 1976 Code, as amended by this act, apply with regard to LIFE Scholarships awarded beginning with the 2004 fall semester.

SECTION    2.    This act takes effect upon approval by the Governor. /

EXPLANATION OF IMPACT:

Commission on Higher Education (CHE) estimates enactment of this bill would result in 10% of those LIFE scholarship recipients who lose their scholarships annually under the existing rules would retain those scholarships. CHE estimates an additional 576 four-year institution, 33 two-year regional institutions, and 113 technical college students would qualify or retain their scholarship under this change with regard to calculating grade point averages. Based on these assumptions the impact is estimated at $3,278,898 annually. In addition, CHE estimates colleges and universities would incur additional costs associated with obtaining records and administering the change in calculation methodology. Additional temporary personnel costs are estimated at $80,000 annually.

The total impact upon enactment is estimated at $3,358,898. The impact on the General Fund of the State is at the discretion of the General Assembly. Additional costs of the scholarships can be covered with state general funds and/or State Lottery Revenue. State general funds and/or Tuition and Fee revenue may be used to cover additional temporary personnel costs.

TO AMEND SECTION 59-149-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELIGIBILITY FOR LIFE SCHOLARSHIPS, SO AS TO REVISE ELIGIBILITY AND RETENTION REQUIREMENTS FOR THE SCHOLARSHIP BY INCLUDING A REQUIREMENT THAT THE CUMULATIVE GRADE POINT AVERAGE CALCULATION, FOR PURPOSES OF LIFE SCHOLARSHIP ELIGIBILITY, MUST BE INCLUSIVE OF THE STUDENT'S GRADE POINT AVERAGE AT ALL PUBLIC OR INDEPENDENT INSTITUTIONS ATTENDED BY THE STUDENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    1.    Section 59-149-50(B) of the 1976 Code is amended to read:

"(B)    Students receiving a LIFE Scholarship to retain it and students currently enrolled in an eligible institution to receive such a scholarship must earn a 3.0 cumulative grade point average on a 4.0 scale each year and earn at least thirty credit hours each year for the maximum of semesters permitted at that institution by Section 59-149-60.
