A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-21-155 SO AS TO PROVIDE THAT A LIFE JACKET, PLASTIC OR RUBBER RAFT OR RAFT OF SIMILAR MATERIAL, SEAT CUSHION, OR A PERSONAL FLOTATION DEVICE OR TOY BEING USED IN AN AREA NORMALLY USED FOR LAWFUL SWIMMING IS NOT WATERCRAFT OR MARINE EQUIPMENT FOR PURPOSES OF CERTAIN PROVISIONS OF LAW REGULATING WATERCRAFT OR MARINE EQUIPMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 21, Title 50 of the 1976 Code is amended by adding:

"Section 50-21-155.    A life jacket, plastic or rubber raft or raft of similar material, seat cushion, or a personal flotation device or toy being used in an area normally used for lawful swimming is not watercraft or marine equipment for purposes of Sections 50-21-150 and 50-21-170 or any other provision of law regulating the use of watercraft or marine equipment.

The provisions of this section do not apply to or negate the requirements for life jackets or flotation devices required to be carried on certain vessels or watercraft."

SECTION    2.    This act takes effect upon approval by the Governor.
