To whom was referred a Bill (S. 580) to amend Section 10-5-235, Code of Laws of South Carolina, 1976, relating to Accessibility Committee for the Building Codes Council, so as to clarify that, etc., respectfully

A BILL

TO AMEND SECTION 10-5-235, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ACCESSIBILITY COMMITTEE FOR THE BUILDING CODES COUNCIL, SO AS TO CLARIFY THAT THE COMMITTEE SHALL ADVISE THE COUNCIL ON MATTERS OF ACCESSIBILITY TO BUILDINGS, STRUCTURES, AND FACILITIES BY PERSONS WITH DISABILITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 10-5-235(A) of the 1976 Code, as added by Act 303 of 2000, is amended to read:

"(A)    On June 30, 2002, the South Carolina Board for Barrier-Free Design is abolished and all functions, powers, and duties of the board are devolved upon the Accessibility Committee for the South Carolina Building Codes Council. All records, property, personnel, and any unexpended appropriations allocated to the board are transferred as of June 30, 2002, to the committee. There is created the Accessibility Committee for the South Carolina Building Codes Council. The committee must be composed of the members of the South Carolina Building Codes Council serving on June 30, 2002, in the positions of the member person with a disability, the architect, the municipal administrator, the public member, and the State Engineer. The accessibility committee shall advise the Building Codes Council on all matters concerning accessibility to buildings, structures, and facilities by persons with disabilities including, but not limited to, amendments to state and federal statutes, regulations, or standards, education of the general public, and local enforcement."

SECTION    2.    This act takes effect upon approval by the Governor.
