TO AMEND SECTION 58-5-35, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EXEMPTION FROM REGULATION BY THE PUBLIC SERVICE COMMISSION OF CERTAIN PUBLIC UTILITIES AND PIPELINE COMPANIES ENGAGED IN THE EXTRACTION, DISTRIBUTION, OR SALE OF LANDFILL GAS DERIVED FROM SANITARY LANDFILLS, SO AS TO INCLUDE WITHIN THIS EXEMPTION BIOGAS DERIVED FROM A BIOMASS SOURCE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 58-5-35 of the 1976 Code, as added by Act 162 of 1989, is amended to read:
"Section 58-5-35. Public utilities and pipeline companies engaged in the extraction, processing, distribution, or sale of landfill gas (LFG) or biogas derived from sanitary landfills or a biomass source, which provide this gas to no more than twenty customers from any single landfill or biomass source, are exempt from regulation by the commission."
SECTION 2. This act takes effect upon approval by the Governor.
