A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 30-5-31 SO AS TO PROVIDE FOR UNIFORM STANDARDS FOR DOCUMENTS PRESENTED FOR RECORDING TO A CLERK OF COURT OR REGISTER OF DEEDS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5 of Title 30 of the 1976 Code is amended by adding:

"Section 30-5-31.    (A)    A document presented to a clerk of court or register of deeds for recording must meet the following uniformity standards:

(1)    The margin on the first page of a document must be three inches at the top.

(2)    Duplex pages are acceptable, except that a duplex page is not acceptable if the printing on the second side is inverted. Continuous form or fan folded forms are not acceptable.

(3)    All names of parties must be typed or legibly printed below the signatures.

(4)    All signatures must be in blue ink.

(5)    Plats larger than twenty-four inches by thirty-six inches are not acceptable.

(6)    A margin of one inch must be on at least one side of a plat.

(B)    A nonconforming document must be accepted for a period of six months after the effective date of this section. After the six-month grace period, a nonconforming document must be assessed a ten dollar fee above the usual recording fee. Compliance or noncompliance with this section does not affect legal validity of the document."

SECTION    2.    This act takes effect upon approval by the Governor.
