VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-1-300 SO AS TO REQUIRE A RETAIL FOOD ESTABLISHMENT THAT SERVES FOOD CONTAINING TRANS FATS OR THAT USES TRANS FATS IN FOOD PREPARATION TO POST A PLACARD PROVIDED BY THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL SIGNIFYING THAT FOOD SERVED CONTAINS TRANS FATS OR THAT FOOD IS PREPARED USING TRANS FATS, TO REQUIRE THE DEPARTMENT TO ASCERTAIN SUCH USE OF TRANS FATS WHEN CONDUCTING INSPECTIONS OF RETAIL FOOD ESTABLISHMENTS, AND TO PROVIDE A CIVIL FINE FOR VIOLATIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 44 of the 1976 Code is amended by adding:
"Section 44-1-300. (A) A retail food establishment, as defined in Regulation 61-25, that serves, or otherwise provides, food containing trans fats or that uses trans fats in food preparation shall prominently display a placard provided by the department pursuant to subsection (B).
(B) The department shall print and distribute to each retail food establishment a cardboard placard not less than eight inches by eleven inches that bears the following inscription in letters not less than three-fourths of an inch high:
'This retail food establishment serves food containing trans fats or prepares food using trans fats.'
(C) The department shall include in its initial permit inspection and in its routine inspections of retail food establishments whether the establishment serves, or otherwise provides, food containing trans fats or food prepared using trans fats and if so, whether the establishment is prominently displaying the placard required by subsection (A).
(D) A retail food establishment in violation of this section is subject to a fine that may be imposed by the department of up to five hundred dollars."
SECTION 2. This act takes effect ninety days after approval by the Governor.
