VERSIONS OF THIS BILL
TO AMEND SECTION 44-53-360, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PRESCRIPTIONS FOR CONTROLLED SUBSTANCES, SO AS TO PROVIDE THAT SCHEDULE II PRESCRIPTIONS IDENTICAL TO A PREVIOUSLY PRESCRIBED DRUG MAY NOT BE WRITTEN OR DISPENSED EARLIER THAN FORTY-EIGHT HOURS FROM THE DATE THE PREVIOUS PRESCRIPTION WOULD BE EXHAUSTED AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 44-53-360 of the 1976 Code, as last amended by Act 396 of 2006, is further amended by adding at the end:
"(j) Prescription for a previously written Schedule II controlled substance may not subsequently be written or dispensed earlier than forty-eight hours before the previously written prescription would be exhausted, except in the case of a terminally ill patient or under conditions of medical necessity, as documented on the prescription by the prescribing practitioner."
SECTION 2. This act takes effect July 1, 2007.
