A BILL

TO AMEND SECTION 59-63-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AGE OF ATTENDANCE IN PUBLIC SCHOOLS, SO AS TO ALLOW CHILDREN WHO HAVE REACHED A SPECIFIED AGE REQUIREMENT TO ATTEND KINDERGARTEN OR FIRST GRADE UPON THEIR PARENT'S PERMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 59-63-20 of the 1976 Code is amended to read:

"Section 59-63-20.    (A)    It is not lawful unlawful for any a person who is less than five or more than twenty-one years of age to attend any of the public schools of this State, including kindergarten, except that:

(1)    Persons A person over twenty-one years of age may attend night schools;

(2)    When a pupil person is in the graduating class and becomes twenty-one years of age before graduation, he is permitted to complete the term if otherwise qualified to do so;

(3)    Students A person may enter kindergarten in the public schools of this State if they he will attain the age of five on or before September first of the applicable school year or have has substantially initiated a public school kindergarten program in another state that has a different attendance age requirement from South Carolina. However, a child who is developmentally ready to attend kindergarten but who has not yet reached the age of five by September first of the applicable school year may attend kindergarten with his parent's or legal guardian's written consent if he meets the following attendance age requirement:

(a)    for the 2008-2009 school year, a child who reaches the age of five by October 1, 2008;

(b)    for the 2009-2010 school year, a child who reaches the age of five by November 1, 2009;

(c)    for the 2010-2011 school year, a child who reaches the age of five by December 1,2010;

(d)    for the 2011-2012 school year, a child who reaches the age of five by January 1, 2012;

(e)    for the 2012-2013 school year, a child who reaches the age of five by February 1, 2013; and

(f)    for the 2013-2014 school year and each subsequent school year, a child who reaches the age of five by March first;

(4)    Students A person may not enter the first grade in the public schools of this State unless they he will attain the age of six on or before September first of the applicable school year or have has substantially initiated a first grade program in another state that has a different attendance age requirement from South Carolina or have has attended a public school kindergarten program for one full school year. However, a child who is developmentally ready to attend first grade but who has not yet reached the age of six by September first of the applicable school year may attend first grade with his parent's or legal guardian's written consent if he meets the following attendance age requirement:

(a)    for the 2008-2009 school year, a child who reaches the age of six by October 1, 2008;

(b)    for the 2009-2010 school year, a child who reaches the age of six by November 1, 2009;

(c)    for the 2010-2011 school year, a child who reaches the age of six by December 1,2010;

(d)    for the 2011-2012 school year, a child who reaches the age of six by January 1, 2012;

(e)    for the 2012-2013 school year, a child who reaches the age of six by February 1, 2013; and

(f)    for the 2013-2014 school year and each subsequent school year, a child who reaches the age of six by March first;

(5) (B)    The restrictions in this section may be waived by the local board of school trustees in any a proper case. However, that if the provisions of items (3) and (4) of this Section (A) are not complied with, the school district is not entitled to receive any state aid for any students who fail to meet these requirements;

(6) (C)    Four-year-olds A four-year-old may attend optional child development programs and all three-year-old, four-year-old, and five-year-old children with disabilities in accordance with their individual education program, may participate in any a public education preschool program, including optional child development programs. Children A child with disabilities served in four-year-old optional child development programs may be counted for funding under both funding sources."

SECTION    2.    This act takes effect upon approval by the Governor.
