A BILL

TO AMEND SECTION 1-1-120, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO FILLING VACANCIES IN CERTAIN OFFICES IN THE EXECUTIVE BRANCH, SO AS TO DELETE THE REQUIREMENT THAT THESE OFFICES BE FILLED, BY THE GOVERNOR OR GENERAL ASSEMBLY, UNDER CERTAIN CIRCUMSTANCES, AND PROVIDE THAT A VACANCY IN ONE OF THESE OFFICES BE FILLED PURSUANT TO SECTION 7-13-190.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1-1-120 of the 1976 Code is amended to read:

"Section 1-1-120.    In case any If a vacancy shall occur occurs in the office of Secretary of State, State Treasurer, Comptroller General, Attorney General, or Adjutant General, such the vacancy shall must be filled by election by the General Assembly, a majority of the votes cast being necessary to a choice. If such vacancy occur during the recess of the General Assembly, the Governor shall fill the vacancy by appointment until an election by the General Assembly at the session next ensuing such vacancy pursuant to the provisions of Section 7-13-190."

SECTION    2.    This act takes effect upon approval by the Governor.
