VERSIONS OF THIS BILL
TO DIRECT THE JAILS AND LOCAL DETENTION FACILITIES IN SPARTANBURG, SUMTER, AND BAMBERG COUNTIES FOR A PERIOD OF TWELVE MONTHS TO OBTAIN FROM PERSONS WHO ARE ARRESTED AND DETAINED A RAPID ORAL OR BLOOD SAMPLE, OR BOTH, TO DETERMINE WHETHER THE PERSON IS INFECTED WITH THE HUMAN IMMUNODEFICIENCY VIRUS (HIV), TO PROVIDE THAT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL (DHEC) SHALL PROVIDE CERTAIN SERVICES TO A PERSON WHO TESTS POSITIVE FOR HIV, TO PROVIDE THAT DHEC SHALL COMPILE A REPORT THAT CONTAINS CERTAIN DATA WHICH IT COMPILES DURING THIS TWELVE MONTH PERIOD, AND TO PROVIDE THAT THE HOUSE MEDICAL, MILITARY, PUBLIC AND MUNICIPAL AFFAIRS COMMITTEE, THE SENATE MEDICAL AFFAIRS COMMITTEE, AND THE GOVERNOR MUST BE FORWARDED COPIES OF THIS REPORT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) For a period of twelve months, when a person is arrested and detained in a jail or local detention facility in Spartanburg, Sumter, and Bamberg counties, a rapid oral or blood sample, or both, must be obtained from the person by a medical or qualified professional health care official to determine whether the person is infected with the Human Immunodeficiency Virus (HIV).
(B) Once a sample is taken, it must be forwarded to the Department of Health and Environmental Control (DHEC) for testing. If the sample tests preliminary positive for HIV, then DHEC must refer the person to the appropriate agency or office for:
(1) HIV confirmation tests to be performed by a medical or qualified professional health care official; or
(2) medical care and treatment services, if possible.
(C) At the end of this twelve month period, DHEC shall compile a report that contains the following data that is taken from the tests conducted in subsection (A):
(1) the demographics of the persons tested;
(2) the race of the persons tested;
(3) the age of the persons tested;
(4) the facilities where the tests were conducted;
(5) the counties in which the persons tested resided; and
(6) the outcomes of the tests.
(D) The report contained in subsection (C) must be forwarded to the House Medical, Military, Public and Municipal Affairs Committee, the Senate Medical Affairs Committee, and the Governor.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
