Let us pray. Lord God, receive the loyalty of our lips and help us to be loyal to those we serve, so that our lives will be what You intended us to be. Let our track record be one of loyalty and concern with the people of this State. Continue to care for us as we care for others. Bless our Nation, President, State, Governor, Speaker, this Honorable Assembly, and all who serve in these Halls of Government. Protect our defenders of freedom at home and abroad as they protect us. Hear us as we pray. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

Be it resolved by the House of Representatives:

That the South Carolina Silver Haired Legislature is authorized to use the Chamber of the South Carolina House of Representatives on Tuesday through Thursday, September 16 through September 18, 2008, provided the House of Representatives is not in session on that date. If the House of Representatives is in statewide session, the House Chamber may not be used on those dates but may be used by the South Carolina Silver Haired Legislature on alternate dates and times as may be selected by the Speaker.

Be it further resolved that the use of the Chamber of the South Carolina House of Representatives by the South Carolina Silver Haired Legislature must be in accordance with the policies and Rules of the South Carolina House of Representatives.

Whereas, the members of the General Assembly are pleased to recognize the breadth of charitable work of the Lions Clubs in South Carolina and to name April 13 to April 20, 2008, as Lions Week; and

Whereas, since 1922 when Lions International first chartered five clubs in South Carolina, the organization has grown to more than five thousand members in one hundred sixty-five clubs; and

Whereas, one of the primary purposes of the Lions is to encourage service-minded men and women to serve their communities with efficiency and without personal financial reward by promoting high ethical standards in commerce, industry, professions, public works, and private endeavors; and

Whereas, for forty-eight years, the Lions ran the State's only eye bank, and since 1988 when they partnered with the Storm Eye Institute at the Medical University of South Carolina to establish the South Carolina Eye Research Center, they have contributed more than one and a half million dollars to eye-research programs; and

Whereas, other programs supported by South Carolina Lions Clubs include leader dogs for the blind, the South Carolina School for the Deaf and Blind, youth scholarships, and sponsorship of Boy Scout troops, youth baseball and soccer teams, and Palmetto Boys and Girls State; and

Whereas, since 1974, Lions Clubs have served the citizens of South Carolina with a Mobile Health Screening Unit, which has screened over two hundred sixty thousand people; and
Whereas, the Loan for Life Hearing Aid Bank has fitted over nine thousand South Carolinians with twelve thousand hearing aids since 1981; and

Whereas, the Health Service Program began in 1978 and has provided over four hundred citizens with cataract, cornea, and related eye surgeries; and

Whereas, the Lions Youth Camps for the Blind and Vision Impaired have given more than three thousand children the opportunity to have a summer-camping experience; and

Whereas, the Lions of South Carolina have challenged themselves to a twelve million dollar capital campaign to establish vision clinics over the State that will provide free eye exams and eyeglass production for needy residents, to found surgical clinics that will offer free procedures to underprivileged individuals, and to expand the Blind Youth Camps to include adults and run all summer, and to create a statewide Youth Scholarship Program; and

Whereas, the members of the General Assembly applaud the perspicacity and enthusiasm with which the Lions have served South Carolina citizens and communities, and wish them success as they plan for the future. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the members of the South Carolina General Assembly, by this resolution, recognize and honor the charitable work of the South Carolina Lions International, and set aside April 13 to April 20, 2008, as Lions Week in honor of the South Carolina Lions Convention to be held from April 17 to April 20, 2008.

SECTION   2.   Section 56-5-1538 of the 1976 Code is amended to read:

"Section 56-5-1538.   (A)   An emergency scene is a any location designated by the potential need to provide fire services, emergency medical care, official law enforcement duties, or rescue, recovery and towing operations. and is An emergency scene is identified by emergency vehicles with flashing lights, rescue equipment, or emergency personnel on the scene.

(B)   An emergency scene is a special hazard that requires reduced speed and additional caution by all drivers approaching and entering it.

(C)   An emergency scene is under the authority of the first arriving emergency personnel, which includes emergency medical services personnel, until the arrival of the fire or law enforcement officials having jurisdiction. All motor vehicles passing through an emergency scene and pedestrians observing an emergency scene must obey and not interfere with the duties of emergency personnel. Motor vehicles and bystanders may not block access to or exit from an emergency scene.

(D)   The management authority of emergency medical services is limited to managing patient care and preventing further injury to the patients and on-scene personnel. This authority may be delegated by emergency personnel to provide an adequate level of safety.

(E)   A paid or volunteer worker at an emergency scene has proper authority to be at and control the scene in a manner consistent with his training. This subsection does not relieve this person from the duty to drive while exercising due regard for the safety of all persons using the highway.

(F)   The driver of a vehicle shall ensure that the vehicle is kept under control and shall reduce his speed and be prepared to stop when approaching or passing an emergency scene or authorized emergency vehicle stopped on or near the right-of-way of a street or highway with emergency lights flashing. The exercise of control required for a driver to comply with this section is that control possible and necessary by the driver to prevent a collision, to prevent injury to persons or property, and to avoid interference with the performance of emergency duties by emergency personnel.

(G)   A person driving a vehicle approaching a stationary authorized emergency vehicle that is giving a signal by displaying alternately flashing red, red and white, blue, or red and blue lights, or amber or yellow warning lights shall proceed with due caution, significantly reduce the speed of the vehicle, and:

(1)   yield the right-of-way by making a lane change into a lane not adjacent to that of the authorized emergency vehicle, if possible with due regard to safety and traffic conditions, if on a highway having at least four lanes with not less than two lanes proceeding in the same direction as the approaching vehicle; or

(2)   maintain a safe speed for road conditions, if changing lanes is impossible or unsafe.

(H)(1)   A person who violates the provisions of this section is guilty of the misdemeanor of endangering emergency services personnel improper operation of a motor vehicle when approaching a stationary emergency vehicle and, upon conviction, must be fined not less more than three hundred dollars nor more than five hundred dollars and have four points assessed against his driving record for the first offense.

(2)   For a second or subsequent violation of this section, if the second or subsequent violation occurs within ten years of the previous violation of this section, the person is guilty of a misdemeanor and, upon conviction, must be fined not more than two thousand dollars or imprisoned not more than two years. However, instead of imprisonment, the court may provide for not more than forty-eight hours of public service employment.

(3)   If a person violates this section and causes serious injury or death to a law enforcement officer, firefighter, emergency vehicle operator, or any other emergency response person in the immediate area of the authorized emergency vehicle, he is guilty of a felony and, upon conviction, must be fined not more than ten thousand dollars or imprisoned for not more than ten years.

(I)   For purposes of this section:

(1)   'Authorized emergency vehicle' means any ambulance, police, fire, rescue, recovery, or towing vehicle authorized by this State, county, or municipality to respond to a traffic incident.

(2)   'Emergency services personnel' means fire, police, or emergency medical services personnel (EMS) responding to an emergency incident."

On or after January 1, 1989, 'employee' means any officer, employee, or agent, or court appointed representative of the State or its political subdivisions, including elected or appointed officials, law enforcement officers, and persons acting on behalf or in service of a governmental entity in the scope of official duty including, but not limited to, technical experts whether with or without compensation, but the term does not include an independent contractor doing business with the State or any a political subdivision thereof of the State. Custody of prisoners by the State or any of its political subdivisions does not in and of itself create an employer and employee relationship between the State and the prisoner. Provided, the provisions of this section shall in no way limit or modify the liability of a licensed physician or dentist, acting within the scope of his profession, with respect to any action or claim brought hereunder which involved services for which the physician or dentist was paid, should have been paid, or expected to be paid at the time of the rendering of the services from any a source other than the salary appropriated by the governmental entity or fees received from any practice plan authorized by the employer whether or not the practice plan is incorporated and registered with the Secretary of State."   /

Amend the joint resolution, as and if amended, by deleting SECTION 1 in its entirety and inserting:
/   SECTION   1.   (A)   There is established the South Carolina Sentencing Reform Commission composed of twelve members as follows:

(1)   three members to be appointed by the chairman of the Senate Judiciary Committee;

(2)   three members to be appointed by the chairman of the House of Representatives Judiciary Committee;

(3)   three members to be appointed by the Chief Justice of the South Carolina Supreme Court; and

(4)   three members to be appointed by the Governor.

(B)   The members of the commission shall elect one member to serve as chairman.

(C)   The primary duty of the Sentencing Reform Commission is to prepare a comprehensive report that reviews and recommends:

(1)   appropriate changes to current sentencing guidelines for all offenses for which a term of imprisonment of more than one year is allowed;

(2)   maintaining, amending, or abolishing the current parole system; and

(3)   guidelines for legislation for offenders for whom traditional imprisonment is not considered appropriate.

(D)   The purpose of the report is to enable the General Assembly to consider the Sentencing Reform Commission's findings and determine whether state laws should be amended.

(E)   In making its recommendations concerning guidelines, the commission must consider current sentence and release practices and correctional resources including, but not limited to, the capacities of local and state correctional facilities.

(F)   The Sentencing Reform Commission must deliver its report and recommendations to the chairman of the Senate Judiciary Committee and the chairman of the House Judiciary Committee no later than June 1, 2009, and the commission shall terminate when the report is made.

(G)   The Supreme Court shall provide appropriate staff for the commission. The chairman of the Senate Judiciary Committee may provide additional staff for the Senate members and the chairman of the House Judiciary Committee may provide additional staff for the House members.

(H)   Members of the Sentencing Reform Commission may receive per diem, subsistence, and mileage as provided by law for members of state boards, committees, and commissions.

(I)   The commission is encouraged to apply for and may expend federal funds and grants and gifts it receives from other sources to carry out its duties and responsibilities. /
